What fricking circumstances? When did we, as a nation decide, that the President and Congress don't get to appoint judges in election years?

Well if she didn't accept the nomination then that would show it was a politically based decision on her part - "I don't agree with the president's interpretation of the constitution so I'll decline to uphold my sworn duty as a member of the judicial system".
