But Jefferson clearly meant that the government should not influence/control the practice of religion, not that religion could not influence government

I’m sure that’s probably true. But is life imprisonment any better if you’re innocent?

And most of them are “innocent” in purely technical terms. Rarely, if ever, are they random innocent dudes plucked off the street. Usually they are accomplices, criminals and people who were involved, or committed other crimes.

Every time I read one of those “innocence project” stories I think that person should’ve stayed in jail. They are almost always a complete POS.

I agree that it does but it shouldn’t! With the abundance of video evidence presented in some cases, the punishment should be done upon exiting the sentencing hearing.

The flip side is they will raise the bar so high to convict murder it’ll be a wash.

While I don't disagree, I'm approaching this from Constitutional angle, not an end results angle. Unless it involves state lines or a foreign entity, this is constitutionally a state issue. We've been letting the FedGov run roughshod over the states for a hundred years under the guise of interstate commerce. I'm not going to support that just because I like the end result.

It only violates the 1st Amendment if the government threatens to penalize you for not administering the death penalty yourself.

I believe in the death penalty, but I also believe in federalism.

States should handle unless it somehow fell under federal jurisdiction.
