Louisiana’s Insurance Crisis is a political problem!

We have a 78 year old commissioner who insists he will run once again for reelection and spent millions to be elected to a position that pays $115,000 per year . Also has a 50 year track record of running for literally every political office in the state and losing most of the time, sometimes as a Dem and then a Republican. I am tired of people who are long past retirement age hanging on for dear life creating policy and making decisions that affect our daily lives. This is rampant across the political spectrum and this country has become a laughingstock because of it. So for the Diane Feinstein’s, Joe Biden’s, Chuck Grassley’s, and other geriatrics of the political world… please go play with your grandkids and try to enjoy life and let the rest of us figure out this shite show you created!

why would any insurance company want to do business in LA, when the state is ran by injury attorneys that try to milk every dime out of them?

And Robert Wooley was close to making it a straight flush...he was being looked at by the state auditors for lavish spending like a Lariat trim F250 and other things that were not adding up. He dipped before the heat got too bad.

Our laws heavily incentivize and facilitate litigation in a way that other states do not. A huge number of our elected politicians, including "republicans" are ambulance chasers at their day jobs. That is who is passing so called "tort reform". The whole thing is a joke but the overall populace of the state is too stupid to understand it, or otherwise don't have skin in the game plus we get to see cartoon inflatables while we drive down the interstate, catchy commercials on daytime TV and bicycle giveaways at Christmas.

Louisiana is a shithole by design and to the benefit of those who designed it and continue to shape it. The discrepancies are very apparent to companies who operate in other states. This is not limited to insurance companies. No one wants to do business here. Perhaps the only silver lining is that at some point there will be no one left to sue.

Not an endorsement, but at least has not gone to jail or even sniffed it. I know him, he's a pretty honest and decent guy.

Not really. Other states like Texas have a lot of advertising personal injury attorneys. Really so many lawsuits are filed because of demographics. Not pc to say, but black folks sue more than white folks and Louisiana is 50 % black.

You aren't wrong, but I think the cause is more economic based rather than simply race.

It's the structure of procedure that creates the problem. Louisiana has a set up that forces you to rush things to court if you want to go to court. One year proscription vs longer periods in other states among other things. The types of industry as well lend to it. The roads lead to it too

This is a myth

Louisiana does not permit punitive damages, for example, except in a very narrow set of circumstances

We also do not permit “joint and several” (called in Lousiana “solidary” liability) unless specified by contract, or in very narrow circumstances to the pt it is irrelevant in tort cases. This prevents a deep pocket from having to pay the whole judgment in a case where the deep pocket is only minimally at fault.

Louisiana also has comparatively speaking, very low “compensatory” (pain and suffering) damages - and tort cases with large awards often result from the unholy alliance of lawyers and pain management doctors (I will not name them)

Louisiana has a culture where ppl are litigious- so while ppl are less averse to filing lawsuits- the damage awards are not usually insane.

The billboards are tacky and obnoxious- but I’ve had friends from other states (including Texas and Alabama) look at me like I was batshit when I’ve told them what I think a general damages value on a back surgery, for example.

Our prescription period is also short, which is very unfavorable for PI Lawyers.

Our insurance rates are high bc of property damages resulting from natural disasters.
