“One taxpayer paid under protest and received $23,000, but there are no other payments under protest,” Robinson said. “You have to pay under protest to challenge the statute. If the taxpayer already filed a return and did not pay it under protest, they would have to file a claim at the Board of Tax Appeals, and that’s somewhat limited also.”

Well, JBE wasn't Governor in 2015. But my assumption is he voted for this legislation and the LDR Secretary Robinson is his appointee.

I don't have a dollar held up in this issue. I'll leave the lines open for the people that were impacted. My public protest of these types of activities will remain here.

I don’t think Kimberly is correct. If the board refuses to hear a case or rules against a taxpayer, it can be appealed to the district court. Additionally, if a law is unconstitutional, it will be argued that a prescription period on monies paid pursuant to that law would be unconstitutional. Finally, taxpayers can amend their returns....or file in federal court. Lots of avenues.

Wouldn't the right thing to do on LDR's part is just refund the payments? Why should the taxpayer be responsible for recouping an egregious error made by the State?

The LDR are damn thief’s.
I had to take my refund case to the Board of tax appeals and at the second hearing the board was getting pissed at them. They were wrong and just refused to pay, when I scheduled the 3rd hearing they finally cut a check.

I have a feeling there are about to be some protests as that particular decision gets brought before the Court as well
