Deposition testimony is, in fact, evidence.
Whether it's credible evidence is a different question. I've spent pages on here explaining why I think the government's job is difficult, but my best guess is that there are numerous credible "leads" from the evidence we have that could be further investigated, potentially.
I think there are things to make those battles uphill - ie, witnesses who want to leave this behind, statutes of limitation, stale evidence/memories/etc.
