Kagan's primary dissent is not the law, but rather Congress isn't smart enough to delegate authority properly lol

They might be idiots but they are not stupid enough to think they could pass some of these regulations as laws and see it through another election...

It is the same reason they refuse to pass a budget... If they were forced to pass a budget it would put the out of control spending front and center...

Making and passing laws was supposed to be difficult...

I can respect Kagan at times and she’s not entirely wrong here. Ted Cruz and Rand Paul, as brilliant as they can be are not environmental experts.

The EPA should be able to advise and consent on legislation, but not enact their own laws Willie Nillie through the executive branch that affects everybody without any oversight from people’s representation.

I.e. she’s not wrong but her heart isn’t in the right place.

Absolutely, but that’s still a far better option than letting govt agencies create/enforce laws bc congress can’t be bothered to compromise with e/o.

What's amazing is how many members of Congress who apparently don't know enough to regulate have extremely clear positions about just how necessary and correct a specific decision by the EPA was. How do they know again?

I trust congress over a lifelong nameless bureaucrat. Back in 1988 the water company in a UK city was supposed to pour an aluminum compound into the early cleaning cycle of the water. Instead they poured it into the finished clean water.
When people got sick and called the water company they just said: "No, your water is safe to drink."
Customers by the hundreds called about their symptoms, the smell, the black stained clothing, their hair glued together after showering.
"No, you're just suffering from hysteria. Water is safe."
They discovered the problem 10 weeks later and fixed it.
When autopsies were done they found aluminum in the brains of customers.
"Not our fault."

They also have an agenda and only rely on the "science" when it suits them... Their agenda overrides all, even common sense...

Tell me congress is lazy without telling me they're lazy. Washington is where the true fat cats reside.

If congress can't make intelligent decisions on the issues of the day, they need to do their homework. Or get the hell out of the way so knowledgeable people can make decisions.

Kagan just endorsed term limits.

I don't want Cheney, AOC, Lindsay "Ladybug" Graham, Jim Jordan, MTG, Tlalib, or pretty much anyone else in Congress deciding laws. But I don't want unelected people who are almost as idiotic doing it either.
