I don't see any reason for this to go to a higher court. No judge can order an agency to enact policy if that policy has been quashed.

I’ve seen retroactive attempts blocked but never from proactive HOA covenants not allowing Sec8

Hmmm, looks like another great opportunity for executive action by POTUS. I'm sure the NAACP and their minion allies are all in favor of this regulation unless, of course, it's in their neighborhoods.

If you gave a poor person a million dollar home in a gated community outright, deed and all, and they were now responsible for maintenance, insurance, HOA dues and taxes,
how long do you think they would last in that house?

that's not quite exactly what happened

That was what they tried to do after they said you could only rent or sell to family I believe

I’m about to move due to this very same issue. It doesn’t give the decent people access to better areas, it give the trash the opportunity to move to decent areas and then turn that area into a shite hole. I first moved in 4 years ago, and the park was nice, no crime, then a ton of trash moved in, and there are break ins, drug periphenalia at the park, trash all over the neighborhood, and fights. Shite will always be shite even if moved to a different location.
