As much as millions want to see Hillary, Comey, and others jailed, it just simply isn't going to happen. Saddens me, but reality is a sad place.

That depends on what your definition of the word "is" is.

I am afraid you are right. But surely a quid pro quo for Clinton is to shut her stupid cunt mouth and to rock on her porch and pretend she cares about her grandchildren.

pretty undeniable that comey had intent to cover clinton's arse, especially since he has been doing it since 2002

Link? Proof? Anything?

Ole just more fake news.

And I still invite the poli board to examine the case law regarding the espionage act. Just to save you the effort - proof of intent is required to convict under espionage act (scotus holding). Otherwise statute violates fair notice requirements

proof of intent is required

You are the first one, I believe, to bring this to our attention. Are you quite certain?

In any case, I thank you very much for bringing this to our attention. I have always wondered why Comey spoke about "intent" while others said that the statute didn't require that.

You can prove intent with one question.

Comey already testified that there were portion marked classified documents in the emails.

The question is "How do you get a document that is born classified and portion marked onto an unclassified email system."

The only way to do that is someone has to willingly and knowingly download the document from the classified server and upload it onto a non-classified system. You cant accidentally send that email. That act is intentional.

Now does that mean Hillary should go to jail - probably not - but whoever did this definitely should be sitting in a jail cell.

Hiring a firm to delete 30k+ emails after you've been informed that you're under investigation is a red flag. The FBI allowing a third party chosen by the subject of their investigation to investigate her computers and send the FBI their findings, the FBI never searched the house where the known unclassified server was in a bathroom.

Those are all facts. What the frick?

Yep there certainly was lack of intent involved with the whole mess...Lynch, and by extension, Comey lacked any intent to pursue charges against Hillary.

Link?

By the way, even if you link this, there was a time when the SCOTUS held that slaves were property. And who can forget their twisted logic with Obamacare. I toss a ruling like you cite in the same category as the other two, total lunacy...in your scenario someone in a position to do so, could wide open expose our national security secrets and do it for untold reasons then skate because intent could never be proven, come to think of it...just like Hillary. How fricking nuts does anyone have to be to go along with this?

But did he intend to receive money in return, or was it just a kind gesture by the clintons? Remember, It's not if you broke the law but if you fully understood it and meant to.

Espionage??? Who said anything about espionage, what about the young sailor in prison for snapping a few pics of his submarine? We don't even have to get near the threshold of espionage you idiot.

FBI Rewrites Federal Law to Let Hillary Off the Hook

by ANDREW C. MCCARTHY July 5, 2016 12:45 PM

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.

"In essence, in order to give Mrs. Clinton a pass, the FBI rewrote the statute, inserting an intent element that Congress did not require. The added intent element, moreover, makes no sense: The point of having a statute that criminalizes gross negligence is to underscore that government officials have a special obligation to safeguard national defense secrets; when they fail to carry out that obligation due to gross negligence, they are guilty of serious wrongdoing. The lack of intent to harm our country is irrelevant. People never intend the bad things that happen due to gross negligence."

US Navy sailor jailed for taking photos of classified areas of nuclear submarine

Kristian Saucier pleaded guilty in May to ‘foolish mistake’ of unauthorized detention of defense information

A US Navy sailor was sentenced on Friday to a year in prison for taking photos of classified areas inside a nuclear attack submarine while it was in port in Connecticut.

Kristian Saucier, of Arlington, Vermont, appeared in federal court in Bridgeport, where a judge also ordered him to serve six months of home confinement with electronic monitoring during a three-year period of supervised release after the prison time. He pleaded guilty in May to unauthorized detention of defense information and had faced five to six years in prison under federal sentencing guidelines."

Too bad his lawyer didn't know about whatever case you are talking about.
