Penc would be interesting but since he was not a direct witness under the FRE
he could be excluded.

The REAL question, IF this goes to trial in the Senate is...
will hearsay "evidence" be allowed in lieu of actual evidence?
In other words, will it be conducted under the laws of the U.S.? If so, then, the impeachment goes nowhere.

Agree, I would think its similar to any defendant having the right to not take the stand
Of course, our legislature has some f’d up procedures in place.
