I would think the Dems would have to put someone up (Biden, Bernie, etc.).

This would have no effect on the term limits of POTUS, so BHO could not "stay in."

There is a two term limit on the presidency. So no. Obama would not just stay in. How do you not know this?

I didn't mean stay in long term. I meant more of a postpone the election.

Conspiracy people have been saying for a while that under martial law there can be no election, didn't know if there were other circumstances where it could not be held.

I'm real basic on my government law though. I know of the 2 term limit but have not clue what happens with all this crazy stuff going on.

HRC cannot be deemed ineligible under any circumstance now. And certainly not by a review of a former investigation as Comey suggests.

IF she was indicted after she is sworn-in, then the House could vote to impeach her. But I doubt the Senate would vote to remove her from office.

The parties have provisions to emergency replace a candidate if the candidate dies or drops out after the nomination but before the election.

It's just never happened before.

Bro, you don't have to worry. There won't be martial law and Obama won't be running again. There is not a person or group of persons who has the authority to declare Hillary "ineligible" to run. The American people can do that by not voting for her, but she will be facing off against Trump as the Democratic nominee. Where the chips fall from there is anyone's guess.

There is a theory that this is intentional so Obama can retain control, effectively overthrowing the government/constitution.

Keep in mind that the Supreme Court is a 4-4 tie right now. We could have a massive constitutional crisis coming.

Should she drop out of the race the election would still be held a week from Tuesday. Nothing in the constitution would prevent it from taking place.

The question I can't answer is how early voting would be counted.
