You're confusing the predicate of an official proceeding with the predicate of criminal activity. I'm not arguing you have to have an official proceeding as a predicate for a possible obstruction charge. In this case, the official proceeding is the Special Counsel investigation. But you do not need underlying criminal activity for an obstruction charge. You also do not need proven crimes to open an investigation.
