I'm not defending the employers here but the only way to make sure you don't hire illegal aliens is to completely discriminate against hispanics and other brown looking people and I'm pretty sure that won't fly, especially in court and the relevant regulatory agencies.

I don't have a problem charging employers, if there is some sort of generally fail safe system in place for allowing them to screen the legality of job applicants that doesn't risk them getting involved in any sort of discrimination claims.
At the same time, I have to think the risk of having a huge part of your workforce hauled out of your facility on a single day and deported, is also a pretty big disincentive in hiring such people.

I'd be curious to know the method of how they were employed. Were they actual employees of the company? It looks like Mississippi requires employers to e-verify all employees.

The best way to stop illegal immigration is for companies to not hire them. The Koch Bro’s know that they are hiring illegals and face no consequences.

My understanding is MS employers are not required to participate in the e-verify process for I-9 Forms. So as long as the employee shows them documents that are not obviously forged and they do not get any fraud alerts when they file the quarterly and annual returns/W-2s; how do you hold the employer responsible?

Until e verify can be used to screen potential employees it is basically useless. As it is now you have to give them the job then put the ball in their court while they are still employed by you. Only after a final ruling can you terminate.

I know you got downvoted to hell but there is a lot of truth in what you are saying. Employers walk a thin line between I-9 compliance on the one hand and Title VII compliance on the other.

When "John Smith" doesn't speak a lick of English and is willing to work for 1/3 of prevailing wage... oh it might be an indication that something may not be right.
The laws we have are so minimal that it's very easy to let employers off the hook.
This needs to change.

The companies just hire through a third party "contractor" and boom they are good.
No effort is spent on prosecuting them because at the end of the day we need cheap labor.
