Covid discrimination... knew it was coming

A Covid underclass is forming
Most Americans will do simple, reasonable things to get ahead. So perhaps it’s a new phenomenon that a stubborn slice of the workforce seems wiling to forego prosperity for dubious bragging rights.
More than 150 hospital workers in Houston are out of a job after refusing to get vaccinated against Covid-19. Houston Methodist Hospital required all workers to get vaccinated, and most did. The holdouts insisted the vaccine requirement was a violation of their rights, and they sued for the right to stay on the job, unvaccinated. A judge dismissed the suit on June 12, calling it frivolous,
More Covid workplace disputes are simmering. Employees of the Los Angeles school district have sued for the right to work unvaccinated. There are similar suits in a North Carolina police department and a New Mexico detention center.
In early June, the Equal Employment Opportunity Commission validated an earlier rule saying employers have the right to require their workers to get vaccinated, except in unusual circumstances. Many employers are probably trying incentives
...obviously a very slanted hit piece but raises an interesting dichotomy on current discrimination that should be pointed out for the hypocrisy it is.

That judge is a piece of shite for not letting the case proceed

here’s my question - are these employers who are requiring their employees take the Covid vaccination accepting the liability that would follow if one of their workers had a severe adverse reaction or died as a result of taking the vaccination? Or, are they relying on the blanket immunity that has been given to the vaccine manufacturers in Congress itself?

keep suing. Eventually, the discriminated against will start winning. If nothing else, business will get sick of defending the cases.
It is wrong what they are doing, and reasonable people know it.

Just like a lot of the judges who refused to hear election cases.
We have a pompous, f'd up judiciary.

Correct me if I'm wrong but, didn't Trump sign off on this as well?

I got a termination letter fr my boss — her new contract with the facility where I work requires that she provide vaxd people. I told her last year I wasn’t taking any vax when it first comes out.
So I got that notice on Monday night. Saturday I received an email saying that the company decided to let us continue to work from home — I guess they realized they were going to be in a bind??
The company is still shite and I don’t like them but my boss is fair, pays well and I like what I do. So I’ve now been un-terminated and can work until they figure out what their stance really is.
Btw no other contract worker or facility employee is being required to take shot — only my position.
I’m glad I stuck to my guns.

Yeah because vaccines didn't exist before Trump.
Jesus you peoples TDS is ridiculous.
How about this... Trump says the vaccine works, but no one should be forced to take it. That's who should be leading. Not a bunch of authoritarian frick stains.

I doubt the judge used the word frivolous also but if the judge did he should be sanctioned

Pre-covid, I would go in to my company locations maybe 4 times a year. They are now offering stickers to put on our employee badges if we show proof of vaccination. With that sticker, we can go maskless in the company buildings. No sticker? You must wear a mask.
I did get vaccinated but not getting a sticker. I want to wear a mask when I go in so that when people ask me if I got the vaccine or not I can tell them that my vaccinated/unvaccinated status is none of their business and it's a violation of my HIPAA rights to ask.

I don't give a f*ck what Trump signed off on. Unlike the Progressive FILTH in this country, I don't follow ANYONE blindly. Trump is still telling people to take the vaccine and yet most of his voters are refusing to do so.

I’m going to have to look this up. I’ve been waiting on the EEOC to offer an opinion on this. These vaccines are still under EUAs, so I’m not sure how they can allow employers to require shots that aren’t fully approved. I’m guessing they’re going the BFOQ route, which is BS.

quote:Okay, how is putting a sticker on an ID legal since it provides confidential information about an employee to all other employees?
Federal EEO laws do not prevent or limit employers from offering incentives to employees to voluntarily provide documentation or other confirmation of vaccination obtained from a third party (not the employer) in the community, such as a pharmacy, personal health care provider, or public clinic. If employers choose to obtain vaccination information from their employees, employers must keep vaccination information confidential pursuant to the ADA.

You should ask them about the "science" for this. If vaccinated, the vaccinated should not be able to contract covid - so they are not at risk from the unvaccinated. The unvaccinated are on their own - and they know that because they have already decided what is best for them. The other possibility for not being vaccinated is having had covid and recovered. Tell them you are asking so you can properly weigh your wrongful termination lawsuit options.

Must be easy to be a judge nowadays. They don't judge shite because nothing ever goes through to actually be judged.

It is a violation of HIPAA rights. Had a few Dr. visits last week, and the sign-in assistant didn't ask about the vaccine, but pointed to a sign asking "Have you been vaccinated." It's kind of odd since everyone has to fill out a lengthy medical form asking all kinds of questions.

Actually had this argument on this very board and it is not a Hipaa violation but an ada violation regarding your medical information which is better because you get attorney fees for the violation
