by prosecuting a woman for filing a false police report -- but dropping similar charges against embattled "Empire" actor Jussie Smollett.

quote:

The judge continued, “There’s no publicity on this case. She doesn’t have Mark Geragos as her lawyer or Ron Safer or Judge Brown. It’s not right. And (if) I proceed in this matter, you’re just digging yourselves further in a hole. (If the) press gets a hold of this, it’ll be in a newspaper. Why is Ms. Clark being treated differently than Mr. Smollett?”

And the hits just keep on comin'

He's right, you know!

ETA: Can the charges against Jussie be reinstated?

This is backwards though. The "error" was in the handling of the Smollett case...not this one.

People who file a false police report should ABSOLUTELY be prosecuted.

Yeah, so what's the answer according to this judge? Just to judicially scratch those laws off the book?

And how the DA's office looks in the papers should not be his concern. Apply the damn law.

Not an attorney: My understanding is they can be reinstated until the Statute of Limitations pass. Since the charges were dropped and he never went to court, it's still fair game for the State/City.

What double standard? Foxx got paid off to let Jussie go and didn't get paid off to let this woman go.

"The law" isn't only about what's written. It needs to be interpreted by the judicial system, typically termed case law.

But if you look at the facts of the Smollett case and see the result, it's a miscarriage of justice to have someone with similar facts be judged differently within the same jurisdiction.

It's why the Smollett case was rightly lambasted far and wide.
