What ever happened to citizen's arrest governor?

New Mexico militia detains migrants at gunpoint until Border Patrol arrives: report

An armed right-wing militia group operating along the U.S.-Mexico border posted several videos to social media this week, including one in which they held about 200 asylum-seeking migrants at gunpoint near Sunland Park, N.M., until U.S. Border Patrol agents arrived, according to a report.

“It should go without saying that regular citizens have no authority to arrest or detain anyone,” the governor of New Mexico, Michelle Lujan Grisham, said in a statement to The New York Times, adding that it is “completely unacceptable” that migrants be “menaced or threatened” upon entering the U.S.

Then deputize them. Police Depts everywhere have auxillary volunteers that are not paid but empowered.

be “menaced or threatened” upon entering the U.S. Illegal is illegal not a migrant worker.

It seems the left politicians would like all illegals to be treated and thought of as legal migrants and this is not the case.

Why are “asylum seeking migrants” not making an immigration station their first stop?

Exactly. They could walk into any POE and be processed.

FOX had a video a couple of days ago showing three buses pulling up to a place on the border where there was no fence and it showed over 300 illegals walking, not running, calmly into the U.S.

They weren't scared. That says a lot.

Been saying for a while the easiest way to stop this Illegal Immigration mess on the southern border is for a bunch of gun owners to take your guns down there and defend the border. Welcome them with a gun in their face.

Because left wingers don't have strong enough wrists to hold a weapon would be my guess.

This is like 5 minutes of shoddy research, but it looks like this citizen's arrest would probably not be legal. Sucks, cause it should be.

quote:

In New Mexico, McGinnis indicates that the defense requires only that one "reasonably believe" a felony has been committed. See 10 N.M. at 280, 61 P. at 212 (determining what the law requires of a person "while rightfully in pursuit of one known or reasonably believed to be a desperate criminal").

...

There having been no changes in the New Mexico law of citizen's arrest either by statute or at common law, we believe that the standard implicit in McGinnis should remain as the law of this state.

State v. Johnson, 930 P.2d 1148 (N.M. 1996)

quote:

Illegal Entry

8 U.S.C. 1325 makes it a crime to unlawfully enter the United States. It applies to migrants who do not enter with proper inspection at a port of entry, such as those who enter between ports of entry, avoid examination or inspection, or who make false statements while entering or attempting to enter. A first offense is a misdemeanor punishable by a fine, up to six months in prison, or both.
