City hires contractor to demolish house, demolishes wrong house. Should he still get paid?

A Hammond contractor is arguing with the city government over payment after he accidentally demolished the wrong house.
The contractor, Jamal Mosely, says there was confusion over which of two structures on the same property needed to be torn down. But the city claims their instructions were perfectly clear and officials don’t owe the business any compensation for the demolition.

The lot at 2413 Center Avenue in Hammond had a brown house and a blue house on site, both vacant and dilapidated. The demolition order was supposed to be for the blue house, but Mosley demolished the brown house.
Code enforcement officer Bobby Mitchell said the contractor’s demolition documents made clear it was the blue house that was to be torn down. The documents from October of 2019 show photographs of the blue house.
But Mosely said that, when he entered the address into the GPS, it took him to the brown house. And he said the brown house was the one with the address number on it.
When he found out that was the wrong house, he then went back to demolish the blue house too. He is now seeking compensation for the work it took to remove both houses.
Story gets better-
quote:
Mosely, who says he’s long worked with the city as a demolition contractor, said he’s never had this kind of miscommunication before, even in instances with multiple structures at the same address. He said he’s now at a loss of several thousand dollars for the additional demolition work on the wrong home.
“They (the city) do things that in my opinion aren’t right, it’s an issue that has to be dealt with and hopefully we can resolve this,” he said.
At a meeting last week, Mitchell told the city council that he thinks Mosley received a call from a competing business that intentionally told him to tear down the wrong house.
“That was actually his fault for listening to his competitor… if there was a discrepancy, the time to ask that was before demolition,” Mitchell said.
However, Mosely said Friday he still plans to move forward in seeking money from the city for the work.

reminds me of a lot down the road in a wooded neighborhood. the wrong lot was cleared AND they took down the electric wires and pole. lost electric. who pays for the wrong lot cleared?

I’m not sure what kind of compensation he’s expecting. He had a contract to demolish house A and he demolished house B. After realizing the mistake he demolished house A. IMO, it sucks for him but he wasn’t contracted to demolish both houses. Paying him for the extra work he wasn’t contracted to do opens the door for him and others to demolish other structures they aren’t contracted for to seek additional compensation.

He should get a check for the house he correctly demolished, then a bill for the same amount for the house he incorrectly tore down.

Did they complete the work according to the contract?
Did a city official direct them to complete work that differed from the contract?
If either are yes, they get paid.
If both are no, tell them tough luck.
ETA: additionally the property owner of the house incorrectly damaged would be well within his rights to file a claim for house demolished without his permission.
Follow the contract and this doesn't happen.

How about next time somebody just rides out beforehand and puts a big orange X on the house that needs tearing down?

Yup. I mean....they gave the moron a fricking PICTURE of the house to be demolished. And it takes just a few minutes to make a phone call and confirm.

If I order a large pepperoni pizza from Dominos, but they deliver one with sausage they will redo and send the right order at no charge. Not sure why contractor thinks he should get paid twice. He should be kissing the cities arse so they dont sue his arse for damages on the house he wasnt supposed to demolish.

Maybe his competitor was hired for that one and is a brilliant a-hole.

Just get him some bbq ribs and a few glasses of lemonade and call it good.

Does the city own the houses? If so, why?

Contractor's dilemma:
The city sent him the picture (above) and contract that said demolish the blue house.
His competitor told him to knock down the brown one.
His solution- knock down both & double your profit

Surgeons have used Sharpies for years to mark correct incision sites for years. Seems simple and silly, but it reduces error
