This is actually the right move for now. They can’t plead the 5th since they’re “pardoned”, so they have to testify or be in contempt.

Well pleasing the 5th is about self incrimination. Can't really incriminate yourself if you have been pardoned

If we assume it was legal, and they are questioned I assume they cannot take the 5th (since they cant be charged) but if they lie under oath then that crime was committed after the pardon and they could be charged.
I am not a lawyer so I dont know if that is right. Any board legal people want to weigh in?

Yes, it’s literally the purpose of the Fifth Amendment. Once a person has total criminal immunity, there’s no risk of self-incrimination.

If they don't want to perjure themselves after the fact by testifying under oath, which in that testimony they could be asked about things either before or after the pardon period, they would still be able to plead the 5th. The only time you can't plead the 5th is if you already started testifying for an hour, then the questions get difficult or you start fricking up your story, you can't just plead the 5th to escape. Or that's what I learned in law class 25+ years ago. It doesn't work like it does on Chappel show or other hollywood courtrooms.

OK, they call your bluff and say, Cheney says, you are damned right I did what I did. I believe what I believe and I acted on it. What ya gonna do? I had protections as a member of Congress and I'm further insulated by Joe Biden's pardon that you'll have to go to court to challenge.
