They do this instead of confirmation. If the vote fails there is no point. That person would be out. Trump appoints to the SCOTUS pre-election and the Senate confirms afterward. If they lose the vote another nominee would be named.

Only can be done if the Senate is in Recess, something that they have refused to do.
Also the appoint only last until Trumps term ends, i.e. Jan 20, 2021. Would have to do another recess for second term and would have to have senate approval to last longer than Trumps second Term

Understanding how rabid and irrational the dims, and a few Repubs, will be, this is the best route to take. Dims aren't going to allow for a coherent confirmation process, so why bother. This is a chance to perhaps solidify some sanity in the SC for a couple of decades. Do it!

Incorrect.
A recess appointment must be confirmed by the Senate by the end of the next session of Congress, or the appointment expires. In current practice this means that a recess appointment must be approved by roughly the end of the next calendar year, and thus could last for almost two years.

I agree. This takes away their ability to delay and all the other shenanigans they pull. They have to vote and if they reject one he just puts another one up.

Good point. I really couldn't see them nominating the same person over and over if they can't even get the Rs to vote for them. But, if you look at Bridget Bade, Trump had to resubmit her and they did cloture etc to attempt to keep her off the 9th circuit. She eventually got approved and she is on Trump's new list.

As long as we have a 5-4 advantage during this upcoming election that is the most important thing.
