2:25 mark at video to hear the explanation. This is what Napolitano said back when they were trying to get Kavanaugh confirmed.

quote:

Andrew Napolitano stated on Fox Business Network today that President Donald Trump could confirm his SCOTUS nominee almost instantly if he uses “recess appointment power.”

“Tell you what Donald Trump can do if this fails — he has recess appointment power. If Mitch McConnell recesses the Senate for 10 minutes he can put Brett Kavanaugh on the Supreme Court for four years without Senate confirmation,” Napolitano said. “I don’t know that Brett Kavanaugh wants to do this. This is real hard ball. He’d have to give up his present lifetime seat in order to do it. The president has that power.”

quote:

Judge Nap says this is how it used to be done. POTUS can nominate, they are put on the SCOTUS next day, and then are confirmed in the Senate during the next 4 years.

They do this instead of confirmation. If the vote fails there is no point. That person would be out. Trump appoints to the SCOTUS pre-election and the Senate confirms afterward. If they lose the vote another nominee would be named.

Only can be done if the Senate is in Recess, something that they have refused to do.
Also the appoint only last until Trumps term ends, i.e. Jan 20, 2021. Would have to do another recess for second term and would have to have senate approval to last longer than Trumps second Term

Understanding how rabid and irrational the dims, and a few Repubs, will be, this is the best route to take. Dims aren't going to allow for a coherent confirmation process, so why bother. This is a chance to perhaps solidify some sanity in the SC for a couple of decades. Do it!

Incorrect.

A recess appointment must be confirmed by the Senate by the end of the next session of Congress, or the appointment expires. In current practice this means that a recess appointment must be approved by roughly the end of the next calendar year, and thus could last for almost two years.

I agree. This takes away their ability to delay and all the other shenanigans they pull. They have to vote and if they reject one he just puts another one up.

You must have missed the part where they said McConnell can call a recess.

Read the article or watch the video clip before you respond next time.

It will give you the information you need to not look uninformed.

It's called a RECESS APPOINTMENT and the President is the one that does it. js

Yes, and no.

He could recess appoint her if Mitch played along, but the term would only run until the next Congress is seated (in January).

Hopefully, Trump has options if Mitch won't play ball.

There’s not a limit on the number of times you can nominate someone

Good point. I really couldn't see them nominating the same person over and over if they can't even get the Rs to vote for them. But, if you look at Bridget Bade, Trump had to resubmit her and they did cloture etc to attempt to keep her off the 9th circuit. She eventually got approved and she is on Trump's new list.

As long as we have a 5-4 advantage during this upcoming election that is the most important thing.
