If passed, the “Police Accountability and Community Protection Act” would significantly restrict when law enforcement can use deadly force. Current California law states that an officer needs to demonstrate that she or he had “reasonable fear” when they reached for their gun, a legal standard that notoriously favors law enforcement.

quote:

The proposed measure dictates that deadly force should be used only when it’s “necessary to prevent imminent and serious bodily injury or death,” said Democratic Assemblywoman Shirley Weber from San Diego, who co-authored the bill. Although some local jurisdictions restrict lethal force, California would become the first state to do so, according to the American Civil Liberties Union (ACLU).

I’m fine with what’s quoted in the OP if that’s the standard everyone else is held to.

The proposal comes after 22-year-old Stephon Clark, who was unarmed, was shot seven times in the back while he was standing in his grandmother’s backyard.

Immediately after the shooting the police officers muted their body cameras, and the department can’t explain why.

After breaking into others property and being reported to be in possession of a gun.

That’s not reason enough to shoot him, surely?
People can report anything. Police should have to see a gun and see that it’s about to be used to harm someone.

After the shooting, police reported that he was carrying only a cell phone.

He wasn’t standing, he was running away and pulled his cellphone out. It could have looked like a gun. They ordered him several times to show his hands.

He didn’t.

Running from the cops is now punishable by death?

No, I was correcting your statement about him just standing in his grandma’s backyard. You painted a dishonest picture of what happened.

Brandishing a phone that might look like a gun could be the factor that got him killed.

Just enforce the laws already on the books. This applies to police and non-police equally. No more excuses like “I’m going to do what I have to do to be able to go home and see my family at the end of the shift.” If a police Officer is suspected of breaking the law, why does the Officer get treated differently than his/her fellow citizens? Weed out the bad ones and the ones who condone bad behavior through their silence.

I have a good opinion of LEOs in general but, just like doctors, lawyers, accountants, fast food workers, etc, there are good and bad. Enforce the laws already on the books.

What they're wanting to change it to seems to me like just a more clear definition of what they are wanting to replace. Jmo

Support but unsure of how this will change much. Cops will say they believed it necessary to prevent imminent bodily injury, so there will need to be verbiage to account for that.

But I overall support. If any of us shot someone reaching for a cell phone, we get put in the pen. So should cops.

That would be nice but it’s clear there’s no willingness to do that from DAs or judges

In other words..You must wait until the illegal alien fires his/her gun at you before you are allowed to draw your gun and return fire if there intent is to actually shot you.
