I agree. It leaves too much wiggle room for his defense as to what he intended to do, etc. Manslaughter has a much better chance of conviction, but ignorant people will riot because of that. Overcharging is not the answer and will lead to an acquittal.
3rd degree doesn't require intent:
quote:
609.195 MURDER IN THE THIRD DEGREE.
(a) Whoever, without intent to effect the death of any person, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree and may be sentenced to imprisonment for not more than 25 years.
I know that if I put my full weight on a person's neck for 6+ minutes I have the potential to kill him. He should know that as well.

The non-existence of a criminal statute punishing that level of "complicit-ness" is not the fault of the court. Any fault for that would lie solely with the MN state legislature, who enacts such laws.

Ah Chauvin. Thanks. Floyd is the guy who is dead for no good reason.
Do you have a problem with the substance of the post of were you just politely pointing out a mistake?

I don't believe his intent really matters with this charge.

Why didn’t a citizen stop it? Should we charge the people filming who didn’t stop it? If you say that’s ridiculous, you’re getting warmer.
I hope they remain fired and that they are unable to get jobs in law enforcement. But I don’t see how you proceed from the clearly ethically wrong behavior to legally wrong without some odd twists and turns.

So this took 3 days?
What the frick was all the rioting for?
What the frick was all the rioting for?

Yup: In 2016, the department rewrote its use of force policy with a focus on the “sanctity of life.” The new rules also required officers to intervene when a fellow cop became abusive.
This is like you seeing a bank robbery and you do nothing to stop it.... should you get charge with robing the bank because you stood there and did nothing? it seem thats what you think.

You think he is arrested if there were no protests?

Intent to kill does not matter with respect to third degree you are correct. Intent was the wrong word to use on my part
They will have to show that kneeling on the guy was eminently dangerous, and that the officer knew that and disregarded that risk. Not saying that’s impossible, it’s just something that is tough to prove beyond reasonable doubt. All the officer has to say is that he didn’t realize his knee was closing off his airway and that his impression was that he was kneeling on Floyd’s back. Like I said, just leaves wiggle room for the defense to play with.

Its probably against police protocol to actively fight other cops who are applying unnecessary force during an arrest.

Has anyone seen video between them taking him from the sidewalk to when they have him pinned down with a knee to the neck?
