If I'm on the jury, he won't be convicted.

The owner will have to justify himself by saying he thought he needed to preemptively attack because he was somehow threatened. The video doesn’t appear to show a threat, implied or otherwise, just an attempt to steal. Was the act of jumping over the counter enough to present a reasonable threat?
In civil society, particularly in businesses vulnerable to robbery, there is a clear barrier in place to protect the employees. It’s not like an Apple Genius Bar or a Verizon Store where everyone is free to walk anywhere.
When you violate the norms to the extent of hopping over a barrier in a way that prevents a store owner from safe retreat, a reasonable person should absolutely believe there is an imminent threat of at least serious bodily injury (which is an acceptable threshold for lethal force).
quote:
What if he had calmly just walked around the counter to take something, justifiable to kill for that?
But that didn’t happen, did it. Why did the criminal not make that choice? One is clearly more aggressive and threatening than the other, particularly when the store owner is cornered. His choice instead was to advance by hopping a counter right where the law abiding store owner was just standing and enter personal protected space while having his identity concealed.
If you’re the type of guy that does not recognize the difference between calmly walking around a counter wearing clothes that signal “I’m no threat” with identity in full view, and hopping a counter dressed to conceal identity and any possible weaponry, you won’t live long in a dog eat dog environment such as this vulnerable store owner.
Stay out of the legal practice, and please stay off of juries.

Yeah, you don’t want to frick with a Chinese guy. They’re very fond of knives and are quick vicious mother frickers. Don’t let their size fool you.

Reading some of the replies - some think the owner should have stopped and broke out his phone and checked the laws to see if he could defens himself - while a masked man in full winter dress (in summer) and his accomplice jump over your counter and you have no escape.
Criminals need reasons not to commit crime. Soft leftist DA’s do nothing but self defense goes a long ways. Its an instant decision whereas online lawyers have all the time in world to decide how they should act. In the end another criminal won’t be jumping anymore counters.

The store owner had to defend himself. The guy that got stabbed made the mistake of going behind the counter near the cash register. The clerk doesn't know if the guy was armed or not, so he had to react to protect himself.

The best part is when he drags him from behind the counter and dumps him like hes taking out the trash.

Paging forum progressives, I'd like an explanation why a racist white supremacy forum is cheering on an Asian shop owner defending his store vs a white robber.

Hooded and jumps counter = full unqualified justification to kill, apparently.
How often do people commit a robbery like that unarmed? I would assume it is extremely rare. I would start with the assumption they are armed, especially when they are robbing the place in what appears to be the middle of the day. Then somebody being brazen enough to jump the counter and start grabbing items with the clerk standing right there. That would further lead me to believe the lack of fear is because they are armed.
I think if somebody presents themselves as a robber like that, that should be a threat enough to justify force. David Dorn went to check on his friend's store alarm and the end result was him shot and killed. If he had the legal right to walk up and start blasting the thieves based on a legally supported assumption of threat by their actions, he would be alive and the world would be a safer place without those thieves.
If this clerk ends up in jail, it is because our laws are too lenient on criminals.

Why can’t you watch the video, it goes to a go fund me page!

The robber wasn’t white he was Jewish. That makes you antisemetic and the clerk a Nazi. He might as well have thrown the robber in a gas chamber.

Imagine security or police getting to shoot every thief trying to run out of Walmart. Fun to think about, but not legal.
What beautiful thought

Looks that way to me, on initial viewing. Busy this weekend, so won't have time to look more closely until Monday.
Unfortunate for the shop owner he did not have the luxury to review tapes over the weekend to see how he should have reacted.

If dude was naked and clearly unarmed, there’s no conversation to have. He lives.
If you make the extra effort to cause others to fear for their safety, be ready to take it from those you wanted to fear you.

That little punk thought he was going to score some easy vape cartridges.
He got more than he bargained for though.
If only every thief received this kind of treatment; the world would be a better place.

Sorry if he was naked, that's a while different type of scary. Sorry, naked guy does same thing, guy is crazy, on drugs or both. Owner still stabs him.
And honestly, strong armed Robert like that where the guy tries to steal by intimidation, knife is fair use. I don't care what the guy is wearing.

Let’s assume for the sake of conversation that 1) this law applies and 2) the perp did not display any weapon and did not do anything other than jump the counter and try to grab something to steal.
Our stabber has to articulate a reasonable belief that pin cushion was going to use an unlawful force against a person present in the place of business.
Unlawful use of force would be strong armed robbery. By jumping the counter, that is unlawful use of force.
The guy has every right to do what he did.
