How exactly does having a secure border "hurt" American communities.

The checks and balances thing kills me.
The statute that authorizes the President to declare an emergency was passed by the Congress.
The same statute affords the Congress the opportunity to override the declaration.
If they can find the votes to do it, fine.
If they cannot, then STFU.
Should it end up before some judge somewhere, they should say the same thing if they understand their role in the checks and balances system.

There is very little down side. If you lose the case nothing happens to you. If you win there is a big pay out. In Britain, if you sue and lose, you have to pay the legal fees of the other party.

Depending on the case, American courts follow the English system. Hell, just recently, Stormy Daniels had to pay Trump's legal fees (nearly $300,000) in a failed defamation suit.
