This is political, not legal. Since ABC answers to the FCC congress has a hook. I’m sure ABC would love to be on c-span and Fox explaining why they spiked the Epstein story. No legal consequences are even necessary, nor should there (probably) be any.
Having said that, I don’t have much confidence that the house GOP has the balls to make much hay of this, but I bet they could if they really wanted to.

Failure to report a crime can lead to being charged with conspiracy, aiding and abetting or accessory after the fact. Depends on the state(s) in which the reporting/investigation occurred.

Every American has the responsibility to report first hand knowledge of a criminal act. If not you are “aiding and abetting” or you become part of the “conspiracy to commit” the crime.
Even an attorney, priest or Dr. can break privilege if they Have first hand knowledge someone is in danger.
Think kids might have been in danger from this guy and his buddies?

These poor Epstein victims have no remedy. No justice against the powerful.
The FBI/DOJ will just turn a blind eye because of the powerful people that would be implicated in such a full and through investigation.

I don't think this is true.
Newcasters are not among the various "mandatory reporter" jobs. Additionally, their freedom of speech/press allows that they also have the right to not say anything on their airwaves if they don't want to.
It sucks that they didn't report. It sucks even worse that they won't reveal what they had now that Epstein is no longer. It sucks even worse than that they went after a suspected leaker to get her fired from a competitor.
But, I think ABC is on solid legal ground unless someone can prove they somehow they helped facilitate Epstein's crimes.
JMHO.
It still doesn't preclude the FBI to obtain a warrant to seek a copy of the tape especially if there is reasonable suspicion that there is evidence of crimes revealed on the tape, and reasonable suspicion exists.
Again, the FBI intentionally fails to do it's job to protect the powerful.
