16 states sue trump/federal government over executive overreach

The lawsuit filed on Monday seeks to stop Mr Trump acting on his emergency declaration to build the wall, saying the president does not have the power to divert funds approved by Congress to pay for his project.

It says Mr Trump's decision is "unconstitutional and unlawful" and that "by the president's own admission" an emergency declaration is not necessary.

"We're suing President Trump to stop him from unilaterally robbing taxpayer funds lawfully set aside by Congress for the people of our states. For most of us, the office of the presidency is not a place for theatre," California Attorney General Xavier Becerra said.

the 16 states are California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Virginia and Michigan, with Massachusetts and Washington almost certainly joining the list soon.

As an attorney who has read literally thousands of complaints, that excerpt may be the most childlike that I have encountered.

Why did Trump have to say “ I don’t need to do this”? Of course that was going to be used to fight it.

The best thing is Trump actually said "I didn't need to do this"

Unless work will be happening in their state, they have no standing. This means that aside from Cali and New Mexico, the rest of them are wasting the time and money of their citizens.

That quote is not wrong. Had the GOPe and Dems given him the money he asked for there would be no need for to declare emergency.

executive power needs to be curtailed. shouldn't be a partisan issue. Republican and Democratic presidents have both been guilty of it.

I would assume if any of the funds being diverted impact their state that would qualify as "standing".
