What would you have done and what are my legal ramifications in this situation.

I’ve always kinda called bullshite on dogs attacking humans until yesterday afternoon. I always felt that an underlying reason existed that may have provoked a dog to attack.

I was in my garage with my two year old doing a little work and he was playing about around the garage.
I see a fella coming down the street chasing two pit bulls so I stand at the garage front and they pass by without harm.
About a half hour later I am still in the garage and my little one is right outside playing in a powerwheels truck. Out of the corner of my eye I see a dog in a full sprint towards where my sons playing.
Everything else happened in a flash, but the dog met met exactly where my son was playing. I did have time to throw my son backward to put myself between he and the dog.
This dog stopped at my feet and was in full attack mode with teeth flared. I did have time to have a cane knife in my hand for all of this as it was what I happened to grab on my way out. I swing and “foul” hit the dog, issentially slapping the piss out of him with the side of the cane knife. This was successful in making him back down a couple of feet so I took advantage to address my son who had retreated to the garage entrance.

At my garage entrance I have a work bench that has a concealed drawer with a .357 in it. I grab it and lock my site on the dog who is not showing agression, but approaching me again. The owner is screaming not to shoot and I am screaming for the dog to leave. Luckily the dog did back down and I did not have to fire.

What were my options here and what could have happened had I fired?

The owner seemed to be just as in shock as I was and was agreed that shooting him would have been warranted.

You acted exactly as you should have.

Nothing would have happened to you if you had to act to protect you life or your family.

And there's this...

Shoot the pit and then find the owner.

I'm no lawyer, but I'm guessing the worst thing could be a discharging of firearm in city limits(depending on where you live) ticket.

And even then, a cop probably wouldn't write that ticket.

You did the right thing.

Nothing would have happened if you shot the dog.

I'm a dog guy.....but wouldn't have remorse shooting one in that situation.

If the dog attacks, shoot that sumbitch. Self defense is not a crime.

this. I'm a dog lover. I'm not a guy that has his hunt ruined by a dog so he shoots the dog. I just can't bring myself to do it. However, do protect your child, 100% shoot the dog.

I was very happy after I settled and reflected on the situation. I had a solid 15 -20 seconds where I was holding dog in my sights at 5 feet.

Although I felt unsafe, I did not feel that unless he approached farther I would be in serious danger.

Take away: Listen in your concealed class and make sure that if you fire it was for a reason.

If the dog was still in your yard, should have shot the dog then whipped the piss out of the owner.

I'm sure I would have tried to kill him with the knife once he was aggressive to my kid. Control your damn dog. Once he's on my property threatening someone, kiss his arse goodbye

Frankly, I'm just impressed that you have a cane knife so accessible.

That was what I wanted to do immediately after the dog retreated away, however my attention immediately went to my son. I truly think that if I didn’t step in in time that this dog nails my son.

The owner is responsible for all of this. That said, he was trying. The owner was gassed from chasing this dog. I had never seen the owner or dog so it was probably a few neighborhoods he was chasing him.
The owner offered a quick appology and said shoot him next time then kept on his chase.

I did hope that the owner would have returned later but he didn’t. I would have offered to put the dog down free of charge.

Police Report/File Charges (with desire to put the dog down.

frick that dog.

My child's life is more important that this never happens again no matter how under control the owner thinks they will be in insuring that it doesn't ever happen again.

frick them.

If I would of seen the dogs running loose I would have immediately put my kids inside, and then look for the weapon after the kids are safe. If he hasn't caught the dogs, the likelihood off them backtracking are pretty good. What the frick is a cane knife? A machete?

Unfortunately, you will never again feel comfortable with your son playing in your yard until you find out where this guy lives and what he has done with the dogs. I would file a police report and get it on record so that the next time these dogs get loose, you have the first instance documented. If they ever stepped on my property again, I'd kill them by whatever means I could.

The kids did get put inside. For at least a half hour.

I did not have a reason To arm myself initially. The owner and dogs passed doing what could be called a brisk jog. The dogs didn’t even glance at that time.

I still chose to give my son a break and put him inside.

30 mins later he wants to be back out and play. I have no reason to say no.

Yes, a cane knife is a machete. I wish I would have caught him flush on my swing. It was a solid backhand with my dominate hand.

That is a given. If I at much as see these dogs again I will not think twice and take them down.

I did ride around a bit after it happened to look for the owner and had no luck.
