The bill may make it out of the House Civil Law committee, but with the regular session being cut short controversial bills that don't involve budgets will likely die on the floor. This one will be controversial.

the solution is to change the law so it no longer uses the 1812 map to decide what is existing state waters. that map says the only state waters are the major lakes and offshore, everything else on that map is shown as land and that is how they are able to claim it is not state waters.

change it to use the current maps today showing where the state is covered in water and what is land.

That's not really the process though. Any competent evidence can be used to prove a body of water was navigable in 1812.

While technically true, competent evidence of 1812 navagability is not exactly available for anything other than significant waterways.
