quote:

However, the provisions of this Subsection shall not apply to running waters passing over privately owned water bottoms where navigation has been prevented or impeded by an obstacle constructed by a private landowner prior to March 2, 2018

quote:

Nothing in this Subsection shall be deemed to establish a change in ownership of the bottoms and banks of any privately owned waterway, and no watercraft powered by a combustible engine may be used to navigate running waters over privately owned water bottoms and banks of waterways in such a way as to cause damage to the bottoms or banks of the waterway.

I like that it does not change ownership of private land, allows gating and does not allow damage.

It is fair that the water can be navigated if it flows with the tide and is not gated.

It should go a step further and prohibit entry during open waterfowl season.

Stuff like this is where I see this becoming a huge issue

I love the idea of access to the waters in general, but it will not take long for some jackwagon to go down someone's tranos and start shooting ducks in someone else's duck pond

"but it's all navigable tidal water bro"

A simple solution would be to change the hunting regs so that in order to shoot from a boat, it must be anchored or something similar. An anchored boat is trespassing unless it owns the property or has the right to be there. It wouldn't solve the issue of a fisherman rolling up on a duck blind but that sucks for both parties and is just something everyone will have to live with.

I don't like the idea of making exceptions based on your chosen activity.

Do you duck hunt a lot? How do you think a boat poling a pond 200 yards away from your blind will impact the duck hunting? I honestly don't know how skittish ducks are but I would imagine a bright blue skiff moving along would discourage any birds from landing within a few hundred yards.

That can't be supported though. The bottom owner can either prevent access or not prevent it.

Seems to be a very regional law. I give it a 7.23% chance.

the sheer number of boats running through shallow marsh now as opposed to 10-20 or 30 years ago is giant... not just poling but running through too... and now at night too with bow fishermen... pushes ducks out of areas real fast

I guess you're right. It wouldn't stop people from blasting through someones hunting spot. As someone who doesn't duck hunt enough to know, do you think the current laws prevent this from happening or at least discourage it?

What about hunter harassment laws? Could they be altered to give people in duck blinds or boat blinds a buffer zone?

No, I have not. I've never duck hunted in the marsh unless jumping rails and shooting them from the platform counts.

I've only duck hunted a hand full of times and it was only in flooded hardwoods. I honestly have very little knowledge about how fisherman impact duck hunters in the marsh.

a duck hunting area can easily be ruined without ever gettingclose to the hunter harassment laws...

in some places yes the law and it being enforced does keep people out.

big difference from 2 boats a day cutting through a shallow bay 35 years ago to 15 - 20 now...

just ban winter fishing. the winter is for hunting, not fishing anyway

If it's public waters that I can fish, I should be able to duck hunt there also right?

This bill won't make it out the house
