Groups that are considering suing NOAA over red snapper plan

What groups are currently looking at suing NOAA that you guys are aware of?

done it many times (LOL) better than suing this multinationals, they have more money and better lawyers.

I don't check the OB much anymore, but I feel like every other time I look there's a tuthilltiger thread about suing NOAA

What are you gonna sue for? The value of the meat missed out on?

Doesn't have to be necessarily monetary in nature.....you can sue someone to cause a specific action. Maybe an injunction to open the season back up??

It won't be long IMO....

"Now, the gulf states are counteracting federal regulations by setting longer fishing seasons in their own state-controlled waters that extend 3 miles off the coast. Florida, Alabama, Louisiana and Texas all have set longer seasons, and last week Mississippi also did.

Some state and federal laws actually conflict, as Mississippi claims control over water going out 9 miles from the shore rather than the 3 miles recognized by the federal government."


(Washington, D.C.) – U.S. Sen. David Vitter (R-La.), top Republican on the Environment and Public Works Committee, made the following statement regarding Senate Majority Leader Harry Reid’s (D-Nev.) decision to omit Republican amendments when he filed cloture on the bipartisan Sportsmen’s Act earlier today. Vitter had filed amendments to the Sportsmen’s bill to give states more authority of red snapper stocks.

“Senator Reid and his cohorts have once again chosen to politicize a popular, bipartisan bill, and in doing so, are obstructing a prime opportunity to better protect and enhance fish and wildlife, wetlands, and recreational hunting access across the country,” said Vitter. “We in Louisiana are very familiar with the need to conserve our natural resources while also protecting public access to them, and I am deeply disappointed that my two amendments – which would do just that – will not be considered.”

Vitter had introduced two amendments to the Bipartisan Sportsmen’s Act in order to bring transparency to the closed meetings of the Regional Fishery Management Councils, and also grant States management authority of the red snapper fisheries in the Gulf of Mexico."

I was somewhat involved in a suit against EPA recently that went all the way to the Supreme Court, and they pretty much slapped EPA's hand and said you over stepped you bounds. This is not unique or ground breaking, arms of the Feds loose lawsuits pretty often.

To shut down all federal snapper fishing of course. Until they have the science that has escaped them for last decade. If it takes them another ten years so be it.

Before you bitch the feds have already informed us there will be no recreational season next year and probably year after due to all the state seasons.

Of Course commercials just truck along. But I wonder how they would get back with no fish for a few years. Litigation is inevitable now.
