I was always under the impression that no one owns the ocean. I remember reading about some guy walking into some rich area on the beach and they were trying to kick him out but he was in the water. If I remember correctly, he never trespassed as he never walked on the beach but instead in the shallow water. Not sure where it was at but thought it was in FL or in Cali.

So even if the woman owns the dock, it isn't like she owns the water or land underneath the dock. Would that be correct to all the OT lawyer baws?

Short answer, it seems as though she does not own the land under the dock. She owns 5 feet of shoreline, likely only out to the high tide mark. I haven't seen a super concise answer but this seems to be the generally accepted thought currently... From the news outlets reporting on it and the baws here.

Covered earlier but don't blame you for not reading back far enough to find it...

Understand the logic.

But I have been asked before. Cop actually said no law against what I was doing but he wanted to ask anyway and it would help him.

This was Ono Island in Gulf Shores...catching specks.

Homeowner was an arse.

Cop was a good dude. I was a good dude. I laughed and told him I understood and moved down.

a-hole "won" but only because the cop was a good dude.

BTW....homeowner had told the cop he thought we might be trying to steal something from guys boat to get them out there.

Ill know more in the next two weeks. Although Pillage and Janky may have to come to determine if there are any bass in there. There could be a million and i could go weeks without getting a bite.

Yeah, this lady could certainly be making it all up, especially given her reaction. If she's right, though, he was trespassing and shouldn't have been there.

I wouldn't mind a push to change some of Florida's laws. The one I'd really like to go away is my requirement to allow access to the beach through my property. It's ridiculous and leads to spring breakers parking where they want and doing what they want. Basically, abusing the law like some fishermen do.

I think this is correct. As I understand it the docks have to be permitted. As in permitted by the state because you are building a dock over water & property underneath it you do not own.

Like I posted earlier they came back and said she owned 5ft of shoreline. I don’t see how it’s feesible he trespassed on her property. You said it didn’t matter our opinions but I ask you is it probable or possible given the width of her dock and she has 5ft that he trespassed on her property/shoreline?

Thought we were getting barney Fife and thats when he came and told us the theft report. But he was anything but Barney Fife.

He looked around told us no problem. Even said...I have no right to ask but it will help me with the homeowner..do we mind giving our names/DL to run...and he understidd if we didnt and would be no problem.

We all gave it to him...laughed and joked as he called it in and he waited for feedback.

Figured it made the homeowner look worse by being willing and report on 3 people came back with 2 traficc tickets total amongst all 3 of us.

You don't think a person could fit in a five foot wide space? She claims to have pictures of him doing so. Until that's proven to be bullshite, I don't see why it isn't possible that he crossed her property or even used it to fish from the shore.

Okay so you won’t talk actual ability for him to enter the water from her property? That’s pretty much her entire claim. She also incorrectly believed she owns the water yet you seem to take her word as fact.

How many inches of shore line would you say she owns on each side of her dock that allow for him to trespass on her property? These are the actual facts of the case aren’t they?

I remember seeing something yesterday or day betore posted on the Fish Joyce’s Dock FB page that the fisherman claimed he accessed the spot he was fishing near her dock via public beach access down the street and had walked over while remaining in the water, which would mean he stayed off her property the entire time. If she has pictures to the contrary, you’d think she’d be quick to show them to the cops so the fisherman would get cited for trespassing. The fact that she hasn’t done that makes me think she doesn’t have the photo evidence that she claims
