Wife of man who drowned in flooded car on Bluebonnet files lawsuit against LADOTD

The wife of a man who died when his car was trapped under the overpass on Bluebonnet Boulevard in Baton Rouge during the May flash flooding event has filed a lawsuit against the city and DOTD.

According to the lawsuit, which was filed in 19th JDC, April Thompson is suing for wrongful death on behalf of her husband, Justin Thompson.

She blames East Baton Rouge Parish and DOTD, alleging they were liable for failing to maintain the roadways, creating a trap for drivers by not providing barricades during the flooding event, for not having a warning device to alert drivers to hazardous conditions along Bluebonnet, and failing to take corrective measures to address the dangerous conditions in that area.

That was a CRAZY fast flood. Despite all of us being Darwinian masters, I see exactly how this happened.The water fell so hard and rose so fast . And that is a death trap in that situation.

I agree they should have had height gauges installed years ago and flashing caution lights when this underpass could hold water.

Only reason I think she has a chance is that the Bluebonnet underpass is near identical to the one at Acadian and Acadian has markings to show how deep the water is if it is flooding there.

Bluebonnet doesn’t have those.

Lived in BR most of my life, I don't recall the Bluebonnet underpass ever flooding like that. In fact, when Acadian is flooded, Bluebonnet is easily passable.

Even if it never flooded before, a major underpass like that is a natural catch basin for water in a flash flood.

It is reasonable to assume there would be a situation where you would need markings telling you how deep the water is there.


I don’t necessarily agree with suing anyone over this but I think she has a case.

So the driver isn’t at fault all for knowingly driving through a flooded street?

Of course not, there is no responsibility anymore .
