I agree with this sentiment whole-heartedly. However, it is bathed in irony just by virtue of being on the OT.

Other than the fact that you complete suck. You obviously haven't ever been in a fight. very often the loser of the fight is the aggressor and the winner is just defending himself.

For example: Ben Shaw Found Not Guilty

The aggressor of the fight was stabbed 9 times and the stabber was found innocent.

Who initiated the altercation
- What was the BAC of each party
- Is there video?
- Did the victim have a pre-existing condition that led to death, when a normal healthy person would've survived injuries (wouldn't matter much in court, I'm just curious)

Man you're really trying so hard to be in denial

I'm not denying anything

I am just curious about the details. I think he's clearly guilty of something very serious and going to jail.

Depending on the answers to my questions, I could have wildly different opinions on the situation.

DA's overcharge so there is room to plea down

Manslaughter is if he hits the guy twice, guy falls and hits his head and dies. Once he commenced to kicking and beating the downed old man, it becomes second degree murder.

None of that is accurate.

Define "good" for me. Most people I know are not even close to being predisposed to start a fight, much less one that ends in someone getting seriously injured.

Its not just a leap from completely harmonious person to throwing fists and kicks down on a 60 year old man.

There's a lot that has to be present in the situation for that to even become a possibility.

Im guessing this guy isn't very good with liquor and has a history of aggressive behavior while drunk. I'm sure his friends have seen him get aggressive on at least one or two occasions while under the influence of alcohol.

It's grossly simplified for the guy who can't comprehend how a murder charge fits here.

If the whole kicking him while he is down is true he deserves to go to prison for a long time.

It's one thing to punch someone and they hit their head in a weird way. It's another to kick a guy to death when the fight is already over.

Huh?

60 year old man vs. 25 year old man.

You think there was any good outcome for the 60 year old?

A drunk, clearly aggressive, 25 year old man.

No way he purposely killed the guy, but seems like a manslaughter slam dunk if i had to guess.

could we stop with this? It's pretty trashy to get in fights unless it's self defense.

Police might've looked at garage cameras, if they were available.
