Granted I went to a private school, but as long as we didn’t answer then during class they were allowed.
Colleges allow their students to keep their cellphones. I can’t imagine how much shite would be stirred up if a professor started physically taking phones from students.

Um. You are supposed to call the school, not your kid. The school is in charge of your kid during school hours. I'm pretty sure you are told this before the school year starts.

A couple of things:
I’m not arguing whether or not the use of cell phones can be disruptive to the learning environment. I’m saying that there are probably better ways to deal with them.
I’m also saying that her personally taking something of high value (beyond misdemeanor in the eyes of the law in some areas) from an individual could be very problematic.
Is it explicitly stated in the regulations of the school/board that the teacher is supposed to remove the student’s private property and keep it in her possession? I think not from the way the OP stated the situation. Therefore, I’d recommend to her that if a student is violating the rules then she should refer the student to the administration.
Ultimately I’m thinking that nothing legal would come if this, but that doesn’t mean that she’s not settling herself up for a potential issue. That’s why I’d advise her against what she’s doing.

My 4th grader takes her phone to school. Turns it off until she's out. Probably half her class has phones and they understand they aren't to be used in school.

Local high schools started allowing cell phones a couple years ago. It has not gone well.

School board policy is that cell phones are allowed in school, but may not be visible, may not make sounds, and may not be used during the school day. The consequence for the first and second violation may include, but does not have to include, confisciation of the phone for a period no longer than the end of the instructional day. For the third offense, the teacher MUST turn the phone into the school office and the parent must come retrieve it.
All teachers have lockable places in their classrooms (closet, desk drawer, etc) and if a phone is taken by a teacher, it must be immediately sent to the office (the teacher can call to have a clerk come get it) or must be immediately locked away until given back to the student. Failure to follow this can result in discipline against the teacher.
EDIT: I would say 98 percent, at least, of the faculty at her school have the same policy. This didn't come out of thin air.
