Literally? nothing to do with it? You cannot possibly be so obtuse. It had EVERYTHING to do with it. He was hauling arse, passing four cars, including an 18 wheeler, in a no passing zone. It was a no Passing zone for a reason. He was coming at the Gold truck at so fast a closure rate the Old man had no choice but to brake and swerve.

Had he obeyed the law, there would not be two dead bodies up here for discussion. .

Agreed. So let’s go by video

Lacy’s driving caused a vehicle closer to him to safely brake in time

A vehicle even further away from Lacy swerved from braking vehicle into oncoming traffic and killed someone

What does that mean if Lacy is in the proper lane of travel already at that point?

It's less than 2 seconds.


And even less than that. don;t forget to calculate the old man was doing 28, so you have a combined closure rate of bout 1.5 seconds.

Wouldn't an eyewitness usually help law enforcement in determining fault, except when they tell the witness what to write and state.

Trooper: "Make sure you put, you had to slam on the brakes, locked up your brakes up, because of the green charger, make sure you write that in there."

Gold truck driver: "I didn't even brake that hard, I didn't skid or anything, I wasn't going that fast."

Gold truck driver: "That lady caused that wreck."

Louisiana doesn't operate under the theory of contributory negligence. Louisiana operates under the legal theory of comparative fault. That's literally one of the first things you learn in Torts.

Not necessarily.

Placing stock into what the driver of the 18 wheeler stated is useless, though. He created a factual scenario that didn't exist out of thin air.

That’s a what if scenario and not what happened though. If it did she probably gets charged with negligent homicide. Lacy’s willful breaking the law is what started the chain of events that led to the accident. If the guy doesn’t stop or swerve does that lady have to freak out and go into the other lane after he had to hurry up and stop or veer off the road?

I’d say the blame lies on both people.
