The first would requires every gun owner have liability insurance coverage for their firearms. The insurance could not legally cover intentional harm caused by a gun owner.

The second requires gun owners to pay an annual fee to compensate taxpayers for the public cost of responding to gun-related injuries and death, including police and medical services.

San Jose is the first city in the country to pass such measures. The new laws are part of a gun control plan Mayor Sam Liccardo unveiled earlier this month following the mass shooting by a disgruntled Santa Clara Valley Transportation Authority (VTA) employee at a light rail yard in San Jose.

“It’s also the case that while the Second Amendment certainly protects the right to own a gun it does not mandate that we subsidize as taxpayers the possession of these guns,” said Liccardo during the virtual meeting.

Liccardo said gun liability insurance is akin to car insurance insofar as it encourages responsible gun ownership, storage and use. He said the fees would be modest – potentially between $25-$30.

Will criminals also be required to pay this fee? How about illegal aliens?

I can't imagine that would pass any type of constitutional scrutiny.

But with Roberts leading the court who knows.

What keeps the insurance company from inflating their prices when they know people HAVE to have it or face legal consequences?

ETA: How will they enforce this without a registry?

So...a legal gun owner is buying liability insurance for a gun he owns IN CASE it hurts someone unintentionally, and also an annual fee for gun related injuries that have ZERO directly to do with his own firearm?

What's "common sense" about any of this? In fact, if asking for an ID to vote is discriminatory because it disproportionately disenfranchises the BIPOC community due to costs associated with obtaining one, wouldn't this excessive cost disproportionately infringe on the BIPOC community's 2nd Amendment Right to keep and bear arms?

So insurance just in case it accidentally goes off and causes some sort of damage?

Gun Liabililty Insurance

Does such a thing even exist today? is the gov't creating it out of thin air just for this law?

Now do the 1st Amendment, I want to see mandatory insurance for any assembly, newspaper, blog, church service, or uttered word... you know just to be safe and show you are responsible.

Exactly. It will do absolutely nothing to prevent gun deaths. All it does is line the pockets of politicians and government.

Now let’s do activist/protester groups. Your activities pose a hazard to communities. You must show proof of protestor insurance and proper fees to cover the cost of policing your activism.

Yeah, ok. I’m sure the taxpayer is what you’re worried about here.

A tax called "insurance" is still a tax.

this makes about as much sense as asking people who eat healthy to pay taxes to cover obesity related health conditions.

If we can make liberal judges that release prisoners early to pay a liability insurance, then we can start talking
