this will not end well.....how can a university expelled students for something that happened off the campus.....especially when no law was broken?
I hope they sue the piss out of the school. You can call them idiots and disagree with their stupid comments, but it still falls under the First Amendment.

I told you when this broke that this whole thing by OU is a massive overreach into dangerous territory.
i wasn't arguing your point, just your style. i was just trying to suggest you offer the argument in more digestible pieces

Finally. He posted it 3 times trying to get a laugh. Now maybe he'll think of some original material to not be funny with.

Also freedom of speech does not mean you're free from consequences.
No, freedom of speech only means that the gov't can't persecute you for what you're saying as long it's not something like yelling fire in a theater or inciting a riot.
The school is a governmental institution so the expulsion on this basis gets kinda iffy but OU should be alright if they can prove they had a compelling public interest that the actions of the students was creating a hostile environment and they needed to be removed.

Did these guys get a hearing before they were expelled? Did the university even follow their own expulsion and disciplinary procedures?

Well quit being a fake arse pirate and maybe he'll stop posting it

Tinker v. Des Moines
This is absolutely an issue of free speech. OU may not have violated the constitution because of some of the carved out exceptions for public schools but it's not clear cut.
The subjects of Tinker were making a legitimate political statement, though. Not frivolous racist comments.

Freedom of speech does not mean freedom from consequences.
ETA: They are not being arrested or prosecuted.

Agreed, but in this case they sang about lynching. Singing a song about Sambo or just using the word "****" (I don't think) would have been as easy to label "hate speech".

only if they can prove that anyone aboard that bus felt like they were in a hostile environment.
If anyone does come forward (I doubt it), and they stayed and partied....games over.

Now if white people want to go through 300 years of slavery and being degraded in order for honkey and cracker to have the same sting of the nword then so be it.
Do you know ONE person that was a slave? No. So, drop your double standard.

This is public institution. No public institution has the right to punish based on free and acceptable speech.
You may not like it...but this is a can of worms for OU.

What they did/said really isn't that big of a deal

Right. It does not prevent people from thinking all the horrible things about them that they want and publicly shaming them. It may, however, prevent a school from expelling them.

Are you saying that these are the only things that freedom of speech protects against? I can point you to quite a few court cases that say otherwise.

Was a law passed which restricted speech that I missed?
The way I see it, students, who attend a university conditionally based upon meeting certain behavior requirements, failed to meet those requirements and were expelled as a result. If you want to shout hate speech go to a university which allows hate speech. Choices have consequences.
Posted on 3/10/15 at 1:14 pm to TheBoo
That is BS. Free speech should be protected on public universities, no matter how dumb it is. Hopefully they at least get all money they have paid to the university returned and win some $ in a lawsuit.
Here is a Washington Post article showing how expelling them for free speech is illegal: LINK

Nope.
Which is why their speech is legal. OU has no right to punish them for legal speech.

Well I'm glad the Constitution disagrees with your "view"...on this and many many other topics.
