Need anOT opinion here - is this stealing?

I’m torn. I don’t think what he did was “stealing” but he sure is an a-hole. The owner left it there by being careless. The guy who then took it shouldn’t go to jail or have charges pressed against him in my opinion. Should he have given it back? Absolutely. But stealing? Nah, I’m not convinced that’s stealing.
