Lawyers of the OT...MIP Advice

Child was given a citation for MIP at LSU in the spring and now has to appear in court. In addition to MIP was also cited for "Drinking in Public" and "littering". Said child is guilty of MIP but not sure on "Drinking in Public" as I'm uncertain on how that is defined. The littering charge was just a dick move. Planning on pleading to the MIP but fighting the other 2 charges. Any advice?

Get a lawyer and don’t try to do it yourself. My ex boyfriend’s brother did that when we went to LSU and had a much better outcome because the parents hired an attorney.

If they admit guilt to MIP, no way can y’all fight the other charges, think about it.

Instead of pleading guilty, see if the DA will offer pre-trial diversion.

Show up to court, tell the city prosecutor or whoever that child will plead to the MIP of the other charges are dropped.
Don’t need a lawyer for these charges. No jail time is faced.

First, you need to ask for pretrial intervention. You should've already done that, but if the court date is coming up soon child can ask for it in court.

If pretrial intervention is not available, then kid needs to ask the prosecutor if he/she can plead to the MIP and have the other two dismissed. They'll likely agree since the MIP is the more serious charge (presumably, it might be the drinking in public).

Don't agree to plead under 894 to the MIP. You usually get one bite at that apple and your kid may want to save it for another charge (DUI) in the future. Nobody will ever give a shite about an MIP

I would not plead my son to anything. Again don’t let him plead guilty. Get an attorney no question. Try to get diversion on one charge and the others dismissed. Then when he completes diversion, he doesn’t have a record.

Are y'all saying this because of the other charges? (I'm not sure the consequences of the other charges, is why I ask)

When I was in school, the advice always given here was not to waste your pre-trial/attorney fees on a MIP because it was basically a rite of passage to get a DUI at some point in BR and you want to have your pre-trial still available if/when you do.

Granted, we don't have the DUI task force anymore.

MIP shouldn't be a crime if he is under 21. So stupid how this all works.

Machine guns, artillery shells, mortars, plastic explosives and tank rounds are A-ok if your 18 and enlist, but not beer, no that's too dangerous.

If you plead guilty to an MIP and you are asked later in life (for employment purposes or whatever), you will have to answer yes. You don’t want that.

Because of the multiple charges, it’s gonna be more difficult to go on your own and negotiate with the prosecutor.

For me personally, I am an attorney and I would get a friend who does criminal law to help me out. If I wasn’t an attorney I would hire one.

it’s a fricking MIP, why would anyone hire a lawyer for that? Sign up for the class, spend the weekend being bored for a few hours, and get it taken off your record.

Even if it stays on your record, nobody cares about an MIP later in life
