'It’s basically negligence' | Parents of 3-year-old shot sues apartment complex

HOUSTON — The family of a the little 3-year-old shot in the head back in April is now suing the apartment complex for negligence.

The Lane family had just moved into the apartment, after years of being homeless, when their daughter Helena was shot just outside the home.

It’s the smile they’ve been waiting almost a month to see.
Speaking to us through an interpreter, Fredrick and Martha Lane, who are both hearing impaired, say their daughter Helena is doing well. She’s just been moved to a rehab hospital.

“She’s doing great. She’s moving. She’s eating. She’s able to swallow," Fredrick Lane said. Helena was shot in the head when someone opened fire outside her apartment back in April. Now staying in a hotel, the family finally moved out of The Palms at Cypress Station, two days ago.

He says they’ve pulled the numbers from the Harris County Sheriff’s Office, and says over the past three years, there’s been 81 reports of gunfire, 41 assaults and nearly 2,500 calls to police.

“Which equals to more than two per day," Aziz said

So they’re suing for two things: financial help with Helena’s care.

“We’re going to have to set up nursing care for in home," Fredrick said.

Homeless for years was safer?

In the thread where the guy's wife was assaulted at the gas station, there were people saying to sue the company. Not sure how it's too much different.

Probably should have checked those numbers before moving there IMO.

If that’s the law and they didn’t provide security then ti can see this being a case.

The real problem is letting an area get that bad before anything is done.

This is exactly how I would see a thread on the lady that burned herself with McDonald’s coffee.

“Never win a lawsuit”
“She knew the coffeee was hot”
“Why should McDonalds care or pay a medical bill”

I’m not saying y’all are wrong, but I can see this family winning a civil suit with a jury of their peers....not because they should though

Security isn't stopping hood rats from doing hood rat stuff.

Parents failed their child. I'm sure they'll sue and get money, but your childs protection is on you.

Isn't it up to the Defendant whether it is Judge or Jury? The Apt. Ownership would be stupid to leave this in the hands of a jury.

Counter sue that the family was negligent, or at least shared in negligence, by allowing the child to play outside, uninsured and unprotected. After all, if the child was insured then the financial burden would not exist. If the child had been wearing a helmet the damage would be mitigated.

The type of security they would need would be someone like that guy from the substitute. He would have to move in with his former special ops buddies and fill some body bags. Then everyone would be up in arms about the mean people enforcing laws.

Prevent thugs from moving in. Lawsuit.
Put up fences and gates. Rent goes up. Lawsuit.
Kick thugs out. Lawsuit.
Work with police to aggressively police the area. Lol.

Being homeless, she probably couldn’t afford better, but she could afford to not let her kid play in that environment. Or she could have started a community movement to change things. Nope, she wants a payout, and her injured kid is the ATM.

The area is not as bad as being reported. Hell, it is 5 minutes from a Top Golf.

So, it’s not the BLM and defunding the police fault, or liberals fault for allowing this to go on, or creating the environment for it to flourish, or even society’s fault for turning a blind eye to it, or blaming the cops and judges for trying to stop it?

It’s the people who give you a place to live’s fault? People who have an investment that depend upon you paying your rent to live there? It’s their fault?

When does it ever become SOCIETY’S fault? When does that ownership ever take place?
