Are you asking because you're planning on producing gay porn videos?

I imagine it would be extremely location specific, and that most places would require a permit issued in advance. But, I very well could be wrong

Pornos are regulated to a degree so no, it's not technically the same. But it's ridiculous nonetheless that people are arrested for a consensual transaction.

I believe there’s licensing involved.

Depends on the jurisdiction.

I would think you need some kind of permit or license to do it.

Depending on the state, it's probably correct.

I do remember a few years back where some older guy invited two 17 year olds back to his boat in Slidell. They had a night of drinking and then a 3-way. He also took pictures of them while doing the 3-way. One of the girls parents found out and called the cops.

In the end, he was only arrested for giving the underaged girls alcohol and taking lewd pictures of them. F*cking them both was perfectly fine, but he f*cked up taking their photographs and serving them alcohol.

I’m married and still pay for sex.

Reminds me of the joke: what’s 5 inches long, 3 inches wide and drives women wild?

A $100 bill

In porn, the “actors” don’t pay each other. They are paid by the producer. Money flows differently than in your scenario. Silly but that is the difference.

Whether making a ... professional adult video is (or at least may be) a crime depends on the jurisdiction. In Louisiana, the most relevant crime is obscenity as defined by Louisiana Revised Statutes 14:106 ( Legislature's website). The statute basically incorporates the U.S. Supreme Court's Miller test ( Wikipedia), i.e., whether "the average person applying contemporary community standards would find that the conduct, taken as a whole, appeals to the prurient interest; and the hard core sexual conduct, as specifically defined herein, is presented in a patently offensive way; and the conduct taken as a whole lacks serious literary, artistic, political, or scientific value."

[ETA]
Prostitution statutes often includes some element of 'doing it with almost anyone for money' to be a crime. See Louisiana Revised Statutes 14:82 ( Louisiana Legislature's website): "Prostitution is ... [t]he practice by a person of indiscriminate sexual intercourse with others for compensation." For example, paying or being paid as a mistress / sugar baby is not prostitution. Presumably the same would often apply to video production.

There are plenty of actor/director/producer combos in porn.

if you are in the scene, operating the camera and directing the action. seems like you could be all of the above.

An actor might own a production company and the money will flow though the production company. That is different than paying a prostitute cash in a motel room.

I have never seen a casting couch video where the cops come kicking in the office door.
