I think there can be a reasonable assumption made from someone who says they can't breathe that they in fact mean they are struggling to breathe, not that they literally can't breathe at all.

In any case, I thought the defense did a good job in their opening arguments. Looks like a tough hill to climb for the prosecution.

Defense sounded pretty straight forward.

Floyd was on heavy drugs
No signs on him that death was due to knee on the neck
Use of force was warranted to authorized to restrain Mr. Floyd
Plenty of signs that death was due to other causes
Floyd toxicology and physical evidence shows he had just ingested meth
Chauvin followed procedures, called for support
Floyd was resisting

Floyd certainly had the opportunity to sit in the back of that SUV and try to breathe. Instead, the man who couldn't breathe decided to try to fight multiple cops.

If the defense can demonstrate the appropriateness of the procedure used by the police (that it was how they were trained to handle the situation and that they did nothing to escalate the conflict beyond responding proportionally to the struggle given by Floyd), then that just about does it with the involuntary manslaughter charge.

That is what's really his best chance. If his actions followed police protocol then you can't put the blame on him.

But you know the city wants him to be the sacrificial lamb. The city is in a no-win. If Chauvin gets anything less than manslaughter, the city will burn and people will die.

dude.. Listening to jury selection and court TV.. They are worse than CNN. They still refer to it as the "murder" of GF.
