Colorado deputy shot and killed unarmed man at point-blank range after struggle

The deputy, Charles McWhorter, yanked 32-year-old Richard Ward from his mother’s car outside Liberty Point International Middle School in Pueblo West on Feb. 22, 2022, after Ward put something in his mouth while McWhorter spoke to him, according to body camera footage released by attorneys representing Ward’s family.
Ward and McWhorter briefly struggled on the ground before McWhorter shot Ward three times in the chest at point-blank range, the video shows.
Neither McWhorter nor another deputy on scene, Cassandra Gonzales, provided medical care to Ward as he lay bleeding on the ground, the footage shows. McWhorter didn’t give Ward orders before pulling him from the car and never gave a warning that he was going to use deadly force, the video shows.
Ward died on the ground outside the school as kids wearing backpacks walked past. The entire incident, from first contact to shots fired, lasted two minutes.
“Richard Ward’s death is a profound injustice — an unarmed, cooperative citizen shot and killed in front of his mother by a Pueblo County sheriff’s deputy,” said Darold Killmer, the Ward family’s attorney. “This was nothing short of state-sanctioned murder of a citizen who should not have been even arrested, let alone killed in broad daylight.”
Tenth Judicial District Attorney Jeff Chostner in October chose not to charge the deputies in connection to Ward’s death because he found they justifiably feared for their lives and acted reasonably. In interviews with investigators, McWhorter said Ward was grabbing his duty belt and he feared Ward would take his gun, according to the letter explaining Chostner’s decision.
But the encounter never should have escalated to the point of a physical struggle or deadly force, according to the wrongful-death lawsuit filed in U.S. District Court against Pueblo County and five sheriff’s officials. McWhorter “recklessly and deliberately initiated a wholly unnecessary and purposeless physical use of force against and struggle with Mr. Ward,” the lawsuit states.
Ward had not committed a crime and was answering the deputies’ questions when McWhorter took him to the ground, the lawsuit states.
“My heart is broken,” Ward’s mother, Kristy Ward Stamp, said in a statement. “I have no words to explain this to Richard’s little brother. Our family has been ripped apart.”

This one is really seems like it has a lot of points to look at.
The guy did look sketchy and the putting of something in his mouth was also indeed sketchy.
You can't really tell due to body position and the camera location if the guy was reaching for the officers gun or not. There was certainly a scuffle but you can't tell from that angle if a move for the gun was made.
If he stops resisting and just let's the cops check him, is he still alive? Maybe. Did he ever actually reach for the gun, sort of inconclusive.
The guy did look sketchy and the putting of something in his mouth was also indeed sketchy.

What law did he break? Is sketchy a misdemeanor or felony?

Not defending the cop, just evaluating all parts of the video that we were able to see.
Nowhere will you find me saying someone deserves to be shot for "looking sketchy."

If you watched the video the guy was acting sketchy...couldn't remember his brothers name....looked like he put something in his mouth....resisted after cops said to stop resisting....does that mean he deserved to be shot and killed?.....no...however he did nothing to help his chances to not get shot.

Even an unarmed person fighting with a cop is looking to get shot. Period. Look up Vickie Wax to see what can happen if the cop simply tries to fight him off.

The only part that would imo warrant lethal force is if he indeed did attempt to take the officers gun. From the video though, we can't see to tell for sure.

It did seem like it escalated quickly. If they find a camera angle that shows Ward grabbing for the gun though, it's gonna be tough to convict.

I never said that he deserved to get shot. However he did nothing to lower his chances of not getting shot. If the guy opened his door and the cops started blasting him....yeah that is bad. It amazes me how people fight with cops....get shot and people blame the cops.

Idk if you maybe misunderstood what I meant but I agreed with you. Being sketchy and all that didn't deserve a death sentence like you said. The million dollar question though is did he indeed try to take the officers gun. If for example both the cop and ward had a hand on the gun and ward was shot in the struggle over it, that has to play a factor.

Seems like he was right to not like cops.
Zero reason to grab and drag him out of the car. And that will trigger fight or flight in anyone. (That's not a gaping vagina)
Note the cops first reaction when the guy is digging for his ID is to put his hand on his gun.

This cop obviously didn't get the memo that he's only supposed to kill black people.
