Can a tire service company prevent you from driving your vehicle?

At a tire/oil service shop and while waiting for my vehicle I overhead a conversation between the receptionist and another customer.

Didn’t get the full story, but it sounds like someone tried to change her tire before she decided to come in to have them take a look at the tire.

Anyway, she only came in with only three out of five lug nuts and apparently they were “badly stripped”

Receptionist told her she wasn’t leaving with her car unless she found another way home to get her remaining lug nuts. Or she had the option to purchase a new set.

Legal?

I'd say its a liability issue with them releasing the vehicle knowing its not right..

Making her sign a waiver claiming they aren’t at fault for that is legal.

Refusing her car to her without doing that? Lawsuit for false imprisonment, which covers not allowing someone to leave with their property in addition to being personally detained.

Yes. If they deem the issue makes the care unsafe.
Usually they offer to fix it for a fee or to have it towed at your expense.

They take advantage of it. Pretty shitty.

I had something like that happen. But I took my car anyway.

I had a dodge ram, that the day after riverside dragged it out a parking spot my wheel broke off. It damaged the rear end so the only way I could fix it was to remove the entire brake assembly on that side and mount the tire to the shaft. Then cap off that brake line. Rear brakes only do 20% of stopping so it was fine.

I bought new tires from Walmart. They put the truck on the lift. They refused service and said it had to be towed out.

I said "ok, but I need to get my cell phone and some stuff out the truck".

I jumped in. Started it and backed out threw it in drive and burned out of there. Then went to find a migo owned shop and got tires there.

Two years later I finally got a rear end at a junk yard and fixed the rear brakes.

On YouTube. There is this great channel.
"Just rolled in" its nothing but cars mechanics don't want to work on or that have very odd issues.
Shocking how many people functionally total their car modding them.

Besides physically taking your car, I’m sure you’d have to file a police report to get them to release the vehicle. You own the vehicle and can claim it’s stolen.

Good for the company in doing that, but I don’t think they should be allowed to if legal.

Sounds like they could just make the argument they cannot put the wheel back on due to the state of the lugnuts. Then, how they hell will she leave with it other than have it towed.

Yeah, and they exploit the crap out of it.

Like they wouldn't rotate my tires cause they said tread was too low even though it was well above the tread wear band.

If they let her go and the tire came off and she wrecks and gets injured, etc you can bet your sweet arse any lawyer involvement would result in the lawyers going after the tire service company claiming that they should have not allowed her to leave.

As for as if its legal, I have no idea but the customer has two choices... Go get the lug nuts or a lawyer. One of those options is a lot cheaper and less time consuming than the other option.

I just watched a 3 minute video. In it two cars had wooden framework.
Multiple had cut frames and random welded metal. Anther car had every fuse at 30amp.

60% of lug nuts is more than sufficient. Them saying they were "badly stripped" sounds like a scam. If they were decent they'd replace them for her at no charge. It'd take about 10 minutes and cost about $1.

I am pretty easy going but some dude at a tire store tries to hold my vehicle hostage on their opinion would have to call the police and an ambulance 'cause one us is going to need both....most of the people working at such places wouldn't know the difference between safe and unsafe on a bet.

Had a tire shop refuse to patch an existing tire or even put on my spare.. claimed both were out of service.

I threw a tantrum a 4 year old would be proud of and they gave me a brand new tire for $40.
