BR man gets manslaughter for killing his robber.

IF you can't click through, a younger guy got drunk and blacked out in front of his hotel very late. He comes to and a guy is going through his pockets for wallet, keys, etc...

The victim starts to defend himself physically, and roughs up his attacker, and the continues to beat him up quite roughly. The robber/attacker dies of his injuries.

The robbing victim was arrested and convicted of manslaughter. Thoughts?

I would suggest there are situations where it would arguably be justified.

I may be wrong on this admittedly, but I think it has to do with whether "extra" hits were thrown after the threat was stopped.


Example: Robber is in victim's pockets. Victim comes to and a struggle ensues. Victim punches robber in the tussle and the robber hits his head on the curb and dies when he goes down. No additional punches or kicks were thrown after the robber goes down. I don't think (think being the key word) this is criminal.




Second example: All parts of the first story are the same except when the robber goes down, the victim proceeds to curb stomp him for good measure when he was already no longer really a threat. I think this is the one that'll get you pinched.

The thing is, when you pass out in public sometimes people try and get your phone or an ID to call someone to come get you.

Sometimes they rob you.

When you beat them to death you don’t really know which one it is.

His story is similar to the guy who shot a burglar dead while the burglar was laying on the ground suffering from previous gunshot wounds.

Some video evidence proving his story would've gone a long way, but witnesses said he continue to kick the guy on ground. Without out a counter to that, Ward is headed to pound-town, la.

About 10 years ago, Had a friend separate from us then pass out in front of a business in the French quarter. An employee went through his pockets to get his phone and call one of his recent contacts to let us know where he was at.
