The homeowner doesn’t know that (technically, we don’t even know that right now). The law is based on the reasonable perception of the homeowner at the time of the action. Someone trying to gain entry into your home at 1:00 in the morning is going to always be reasonably perceived as threatening.

If my family, my wife and kids are in that house... even if they're not... and I give the guy plenty of warning to get the hell off my property, fire a warning shot and he still advances, I'm shooting the F out of him. I’d still say you have a hell of a lot of options that don’t include shooting him.
Drunk kid in trunks? Give him a shout from the door or window. He keeps stumbling about and you call the cops and keep an eye on him.

That's assuming you know the kid is drunk. I never, ever want to be in that situation but late at night person acting erratically could also be explained by crazy, high, ect.
Also depends on whom is home. If it's just me I'm far, far more willing to take chances to not kill someone. If my gf/wife/kids are with me, people get far less warning if I truly feel threatened.

I doubt your kids would be super excited about a dead guy and dad on trial either. It’s not exactly threading a needle to find a middle point in this

Could be a zombie hopped up on bath salts trying to eat the brains of children…
But as mentioned, your girlfriend, wife or kids are all probably much better off 999 out of 1,000 times with you not shooting unless you think he has actively begun to breach the house.

Counter: you get it wrong, you go to prison and leave a single mom taking care of multiple kids while you are in a cell. Maybe your 8 year old gets to see a dead guy. Not super awesome for a family either?

If you call 911 and say you heard something outside they wont show up here at all.

Going outside and telling him to leave is very reasonable. Killing the persons when they come at you after that is perfectly reasonable to let them meet their maker
