Lawyers for Alton Sterling's five children are willing to settle their wrongful death lawsuit against the city-parish for $4.5 million, but only if the East Baton Rouge Metro Council agrees to pay the money over three years instead of five years.

The Metro Council on Feb. 10 approved a settlement offer which proposed paying $1 million upfront out of the city-parish's Insurance Reserve Funds, with the remaining $3.5 paid out of the municipality's annual operating budget in equal installments over the next four years.

The revised offer — which will appear before the Metro Council on March 10 — proposes paying $2 million upfront with the remaining $2.5 million paid out over two years, according to a copy of the agenda item. It doesn't specify where the funds will come from, though that information is not required.

Mayor Pro Tem LaMont Cole confirmed that negotiations among city-parish attorneys and Sterling's family lawyers yielded the new proposal, and said that if it gets the green light from the parish's Finance Department, he expects it to pass.

"If this payment arrangement doesn’t disrupt the budget, then I think it's wise for us to move forward with all deliberate speed for the sake of our city," Cole said.

The good news is it will frivolously make it back into the tax base because I am sure it will be spent rapidly.

I'm sure they are. It's free money for doing absolutely nothing.

If the parish has $4.5M laying around, why had it not been returned to the taxpayers?

It’s insurance that covers it. It’s not $4.5m laying around. Hence the taxes or fees going up because the premiums are going to go up.

Everyone wants their cut sooner rather than later.

Alton Jr needs it to pay his attorneys to keep him from getting his balls chopped off and flushed down a toilet at Angola.

Maybe they think that the St George suit goes away by then and EBR’s kitty shrinks significantly after 2 years.

Yes it is. Max amount recoverable in general damages for the death is $500K total and the max amount recoverable for his personal injury is $500K. You add in economic damages in the form of loss of support to the minor children and you get nowhere close to this proposed settlement amount. If the defense attorneys recommended it, they’ve collectively committed legal malpractice. One of the plaintiffs attorneys has been mentioned as a candidate for U.S. Attorney appointment. This case should be tried.

Fill up Councilwoman Denise Amoroso’s email box opposing this move. She would be the most likely council person to not go along with it that had earlier voted yes. Take it to trial.

I wonder if anyone is helping explain to the family that 40% will go to taxes and i would wager to say that 20-30% of the money will go to the lawyers.

Not that it’s nothing but out of that, the family will keep about 1.5 million after it’s all said and done
