I completely agree with you, but what is the solution? Capping how much lawyers can make? I'm all for a budget neutral method of pumping more money to public defenders, but I don't know how you can "make it even" with big money types without shitting all over civil liberties.

Problem is there was no evidence of sex trafficking going on and similar charges in that district usually end in a fine for the accused

Police fricked up an investigation, then realized they had a big fish on their hands so they tried to blow up the case into a huge sex trafficking case that didn’t exist, and then tried to extort Kraft into pleading guilty to ensure the illegally obtained video tapes were never leaked to the public

Not to mention they made up a reason to pull Kraft over after the visit to the massage parlor and then made him show ID even tho he was not driving and they had no reason for the stop.

Again this case is being dismissed because the police fricked up, not because Kraft has money

Nah, police frick up routinely and the DA helps cover it up. It went away because he had money to lawyer up.

Yeah unless it's a lady getting shot in her bed room after some plainclothes officers kick down the door unannounced making her boyfriend react as anyone of us would and shoot the invader.

I always thought it ofd that their were alot of cocky people shooting off about how Kraft was going to do hard time on this. Clearly the police were going to massage the charges. Whether you like Kraft or not, at least there was a happy ending to all of this.

A semi-competent court-appointed attorney would have likely made that same argument and Motion to Exclude. Hell, the videos and warrants were ruled as unlawfully obtained at the trial court level. It was the DA who filed the appeal, not Kraft. The DA's argument that he was only able to get the charges dismissed because he had the financial resources to dissect the minutia of the warrant is a cop out IMO. If the courts were to give the government such broad discretion for secret surveillance, it opens up a very large slippery slope for 4th Amendment protections. The only smart thing that DA said was their reasoning of not appealing to the FL Supreme Court so they weren't in danger of having an entire FL statute over-turned as it pertains to "sneak and peek" warrants. I don't think the government should have the ability to set up hidden cameras at 10 location across the area and video tape every second at these establishments in hopes they find some wrong-doing. You'd be talking about many totally innocuous massages of innocent parties being video-taped, possibly nude, without their knowledge, in hopes of maybe catching a couple people paying for sex, which wasn't even the purpose or scope of their investigation.

The whole basis of the warrant was to obtain surveillance of sex trafficking acts, yet they used the warrant to document everything that happened in that parlor. I think any ruling that protects citizens' constitutional rights is a good thing. And honestly, the term "sneak and peak" warrant sounds like something that needs to be addressed in their state legislature and/or through the FL Supreme Court.

Those people were dumb. Even with a conviction, Kraft wouldn't see anything more than a fine and maybe probation. His only real concern was the videos being made public and him being embarrassed.
