After thinking about this for a bit they have the touchback rule right. Here is my logic for this. Fumbles are caused by two things.

1. Defensive players making a good play.
2. Offensive players making a bad play.

The touchback rule rewards defensive players for making a good play and punishes offensive plays for making a bad play. Any change to the rule would punish a defensive player for making a good play and reward an offensive player for making a bad play.

If he fumbles it out of bounds at the 1 inch line it's still Cleveland ball. With this logic any fumble out of bounds should be the defenses ball then.
