Going to a party means you consent to getting shot?

The plaintiff knew, or should have known, that a shootout was a reasonably foreseeable outcome at a party where Aldon Smith was consuming alcohol.

I literally had my #99 jersey ready for a road trip and put it back in the closet. Any fan that can look their kid in the face and say "don't do drugs or dont drink and drive" while wearing a Aldon Smith jersey this weekend has a serious conflict of issues.

Even if he isn't suspended this weekend, which he should be, I doubt Harbaugh puts he on the field.

Ahhh, the old "Officer, I was in full control of my vehicle , eyes on the road, going just below the speed limit, when this deer just came out of nowhere and I had to swerve and ..." routine.

Works every time.

According to a neighbor who witnessed Smith's one-vehicle crash ahead of the arrest, Smith's foot remained on his car's gas pedal, which was against a tree as police arrived. He was passed-out drunk at the wheel with weed in the car. Smith is seriously lucky to be alive today, and also lucky he didn't kill anyone else. We understand the 49ers' desperate want to win football games, but there needs to be some immediate discipline for this. Sep 20 - 5:00 PM

In an unbelievably knuckleheaded move, Smith partied all night and tried driving to the team facility at 7AM in the morning. He was smashed drunk with weed in the car, passed out at the wheel while hitting a tree, and still didn't wake up, as Smith's foot remained on the accelerator when police arrived. This is Smith's second DUI as an NFL player. He's in his third season. Sep 2

Which is weirder, him trying to drive drunk (blew a .15) to team facilities at 7 in the morning for some reason?

or the fact that he practiced a couple hours after all that went down?

Neither. Combined those are indications that he's an alcoholic.

Harbaugh said that he had his wits about him at practice. So, yeah, Aldon Smith is an alcoholic. He needs help.

That PFT quote is bullshite. Unless he got drunk in his car, how could he be too drunk to get out of it? He must've gotten into it somehow.

Perhaps some other factor explains him being passed out in the car, you know, like colliding at high speed with a large solid object...

With his salary why can't he hire a driver whenever he goes out anywhere?

This can be said for any pro-athlete. A driver, car service, or one of his "boys" should drive. If I were him I would make one of his boys drive. But I did hear it was 7AM!!!???
