question about unemployment

The wife's shop was closed due to covid. So she file for UE. We put in all the data on how much he made in the past quarter which then got approved. Got a letter in the mail yesterday saying that she wasn't eligible for UE and that it has to be repaid. The reasoning is a base period wage decrease.
Letter gives 15 days fo file appeal.

She should certainly qualify for the Cares Act federal side of the unemployment payments since it covered anyone put out of work or business due to Covid whether they paid into unemployment insurance or not.

That’s bullshite. Exactly what the other poster said Federal Cares Act. Did y’all submit a 1099? We did because our self employed business is still shut down thanks to JBE.

I saw conveniently read today that JBE said he’s getting ready to impose a surcharge on businesses because unemployment funds are running out. They applied for a government loan, because the money’s running out and Congress was supposed to extend it and didn’t.
We got a letter Friday saying they moved our unemployment from the federal pandemic to the disaster program when we didn’t even file a disaster claim.
No coincidence that your wife just happened to get that letter in the mail. JBE is trying everything he can to rip taxpaying workers off and get federal money. It’s pathetic and disgusting.

I had an employee that I had to lay off call me today and he received the same letter today. I have no idea what the hell is going on, was approved from the beginning and now workforce demands he pays all money back due to requalification. I appreciate any information this board can furnish that will help with this problem.

Not exactly.
To get the initial CARES $600 federal payment you had to receive at least $1 of unemployment from state. If she was denied she would not have been eligible.
Similar with the executive order $300, you had to receive $100 in state unemployment to be eligible for the $300 federal. If she was denied she wouldn't be eligible.

That wasn't a problem in NY, at least not so far, but it sure sucks for LA in that case.

We have offices in Alabama and Florida and in both of those states you had to receive at least $1 of unemployment to get the $600 CARES UI. I didn't think it varied by state but I haven't looked into it anywhere else.
States are interpreting the $300 executive order differently so I have no doubt NY is different than LA, AL, FL.

Nobody is giving enough info to offer a useful answer. What are the base period wages reported? Those 4 quarters check your highest quarter + 150% for the remaining quarters to determine eligibility. ....if you didn’t work a quarter or two in the prior year, a redetermination letter is likely coming after the claim is adjudicated.
As someone else said, with the CARES act you could provide a 1099 to prove self employment during those blank quarters to qualify.
