Cosign for ex for vehicle, i pay her 1000/month child support, she has physical ownership of car, both names on title, she is constantly late on payments, what would you do ?

should have got your name off that loan at the divorce. If you cosigned after the divorce

get it refinanced in her name, sell it, or you make the payments.

Make the payments and deduct from her support. Make sure you document that you paid.

Did you use an attorney? I would go back to them.

I would tend to say, pay the payments directly and notify her legally that you are deducting the amounts from child support.

Not sure how a judge would look at that, though.

Doh, misunderstood that part.

Not sure you can legally deduct anything from the child support. Depending upon how vindictive she is, she may can take you back to court over that. I don't know though, not a lawyer.

Was this not hashed out during the divorce proceedings, assuming she's an ex-wife? Every divorce decree I've read address any outstanding loans and how they'll be handled post-divorce.

Sorry, i did not clarify, we have been divorced over 11 years, about 3 yrs ago she asked me to cosign for the vehicle, well seeing that my children ride in it also , ages 17 and 14,i cosigned for her, i paid down payment of 4,800, but she absolutly refuses to pay note. My daughter now has own car, my 14 year old son is supposed to stay with her 14 days while i am offshore, but he spends most of them days with my parents. Just getting sick and tired of Ford credit harrasing me every time she will not make payment.Just wondering if anyone else has been in this situation.

Tell her you'll pay the note if she'll sign a promissory to you so you can "write off the amount" Of course that would be a lie, but frick that count.

After she signs you start paying the note and send her the support check each month minus the amount of the note. IF she bitches, send her a copy of the promissory stating she owed you that amount monthly.

NO WAY she spends money ($5k retainer) on an attorney, and if she does all the court will do is order you to pay full amount (worst case scenario). IF the court does that, then you sue her in small claims court and win a judgement against her and interest starts accruing.

The signed promissory will keep her from taking you to court, she isn't that smart....which takes me to you..

You aren't smart, LOL Who the hell gives an ex (who probably fricked you over to begin with)$4800 AND cosigns on the same vehicle? You must have some SERIOUS guilt issues when it comes to what happened to your marriage.

1) Pay the car note and deduct from the monthly child support check, including the receipt showing it has been paid. Hope that this is allowed by law or she does not push it

OR

2) Consult with the child support department at your local courthouse and see if option 1 is a legal option with no recourse.

OR

3) Bitch about it on an internet message board while she continues to ruin your credit.

Looks like you bought your ex a car.

I would just plan on paying the note and not sweat it. You can get riled up every month or pay the note and live without the stress.
